    According to the article, the parked driver did so illegally. I'm sure he has learned a lesson, albeit the hard way.

    Just a sad situation.

    yes, yes it is...i do not advocate parking on shoulders, or exit ramps. here in my state (RI) many times i will see a parked rig on the shoulder of I-95 southbound near the airport, where the shoulder is extremely wide. i see state troopers all the time, passing such rigs. meaning, they are not getting them to move...

    maybe that wide shoulder..??

    the driver in this article will most certainly be sued, perhaps too his employer...did he run out of time.>??

    we have all read where drivers even RIGHT HERE on this site, have said, they will Pull over, when thier clock runs out, no matter where they are..

    maybe that was THAT drivers way of thinking as well..??

    will he and his company use the ELD device as the culprit in the lawsuits..???

    I am not an attorney, but I watch them on TV.
    Here is the legal theory:
    Illegally parked vehicle(vehicle A) gets hit even if he is well off the traveled portion of the highway.
    The vehicle that struck the illegally parked vehicle(vehicle B) would not have done so if vehicle A were not there.

    No one knows what would have happened when vehicle B went off the traveled portion of the highway if vehicle A was not present.
    It would have been deemed irrelevant because the courts deal with facts in evidence, not with conjecture or hypothetical situations.

    That will be $ 750. 1 hour or portion thereof of legal time spent. Please remit to the address in the envelope.

    I did a Lexington, Va -Knoxville, Tn turn this morning. I lost count of the trucks on the shoulder after the count got to 20.

    It's also good if you move over for said parked vehicle and not run into them. Also stop pulling from the shoulder immediately onto the travel lanes. Its stupid and dangerous......

    I asked that question of a police officer when i was 17 years old getting my first speeding ticket.
    As he was writing it out, I pointed to the cars whizzing by also exceeding the speed limit. I asked him why he wasn't citing them.

    "If I had the resources I would cite them also. I don't. But I do have you. Here is your ticket."
