My husband is a truck driver (owner operator) and he drives under sunrise logistics MC and DOT since we don't have are own. Last May he did a produce load. At the delivery the load was rejected but unloaded. And the claim got opened. Write after he got unloaded he went to 3rd party dealer and did the reefer download which clearly states temperature was good the hole trip and only got to to critical when he was at the duck getting unloaded because the doors were open sometime now. After insurance did review they declined the claim and said they will not pay on it because the product didn't get spoiled then we were transporting it it masr have been already bad or loaded hot. Now Johanson withheld over 40k ( balance of thr claim) on other load from Sunrise amd Sunrise is withholding it from us. The the company doesn't want to ruin the relationship ship with broker amd rolk us to hire the lawyer . But so fur what I found is only 1 lawyer who could take the case but how much they charge 50k up front . With all of this now I don't know what to do. We didn't do anything and now we have to pay over 40k. If anyone can recommend something I would really appreciate it.

I'm not sure you can go after the broker in this scenario, I think you have to go after the company you were driving for. If you were an owner/operator with your own MC I would say you could file against the broker's bond (not sure if you would win) but that isn't going to work in this scenario.

2. Did you demand a USDA inspection? You might have to wait a day for it. If you left without one good luck, you're stuck with the claim.
