Wow. 17 pages on this topic in 8 days, no activity for 4 months, and then it is dredged back up, all over a "no brain-er".
This driver should not have been in the sleeper consuming that quantity of beer. I'm not a tea totaling tight wad, nor do I condone drinking in the truck. However I can see a driver having one beer, before going to sleep.
I'm betting that the driver whom is the subject of this topic, was called in by a Swift "safety contractor". Otherwise, Swift Corporate would never have called out the police, not on an "unconfirmed" alligation. Companies don't do it, due to liability issues.
Yes, the employer does have liability, if they call out the police on an "unconfirmed" alligation, and the police find that the "complaint" was an invalid one. If an unidentified caller had called this in, I would bet that "Swift" management's first reaction, would be to get which-ever safety contractor was working that particular area, out there to confirm the allegation. Once confirmed, they would then call out the Police, to get the driver out of the truck.
It's hard to believe that a driver was dumb enough to drink that quantity of beer, with the curtains open for the world to see.
I worked in the safety department of a major "private fleet" company in the 80's, for 7 years. The scenario I described, was exactly how the company handled "alligations" against drivers, whether it was booze or drugs. Before the police were involved, we confirmed the facts. This kept us from being sued by those drivers, for falsely accusing them of anything. I do not see Swift or any other major carrier, acting any differently today.leannamarie, oldcornbinder and AfterShock Thank this. -
I have to agree with you on this Gorgeous George, I had a guy come in and he had drank so much the night before you could still smell the strong odor of alcohol coming from him, had to send him home in a cab so he would not be drinking and driving on his way home to sleep of the rest of his partying. THEN when he came back to work the next day we had a talk!!!
When someone reports this information to a company it has to check it out or they could be in the deepest pile they have seen.
Policy is policy for a reason not just because it screws with people. -

Whereas this subject may have been hashed over and hashed out
in 8 days four months ago by those who responded,
I think it's a subject that wouldn't hurt anyone who hasn't read it yet
to review.
I think, many times, new readers may not invest the time to read the
entire thread when the threads are long,
and instead, jump in at the top.

I received a 12 month suspension before just for being in my truck and having beer in my system. They were doing random inspections early in the morning and got busted. I could understand if I was driving but just being parked get a BAC .04 on my record. We live in these trucks while other jobs people get to go home, so we don't deserve a beer when we are parked? Mine was on a Saturday morning and had all weekend to drive about 400 miles. I had no plans on driving until much later and the 1st time I had any beers in two weeks. To claim he doesn't have common sense is unfair and you will probably say the same about me but maybe you lack common sense. To tell someone that lives in a rig nonstop they are stupid for having a few beers, not driving or planning to, is unfair. We are human and just because we already sacrifice everything to be out on the road doesn't mean we are no longer human.
