Yup but that was only half the scam.
After getting away with not doing their job for a long time, the planners at Laredo figured they could make an extra buck by selling the available loads to drivers hanging around in the terminal. The longer they were laid over the more they would pay. Drivers were laid over 3days or better at Larado while the yard was full of loads going nowhere, and this was going on for years before Jerry was informed of the situation.FerrissWheel Thanks this. -
Well, isn't that something?

And that money was going right in there pockets, I'm sure.
They should've not only been fired, but also charged criminally because that's basically stealing from the company.drvrtech77, Toomanybikes, FerrissWheel and 2 others Thank this. -
Basically. Fraud and embezzlement, anyone?
-
That's about the way I'm looking at that...

How did Swift manage to stay in business with all these loads sitting and going nowhere? There must have quite a few complaints, perhaps uproars, as to what was going on the undelivered freight.

That may go in in the LTL world to a large degree, but I'm thinking in the world of OTR shipment tracking is not quite as prevalent.FerrissWheel and born&raisedintheusa Thank this.

Would you have reported all this to the district attorney? Fraud and embezzlement are punishable by law, often resulting in doing time at the penitentiary.

Yup. Throw them in general population and them to remember this one simple rule: "Don't drop the soap!"
-
A driver doing that would be pretty much pointless.
One has to have standing to argue before an appellate court, that is, being affected in some way by the case in question. I'd imagine this wouldn't be any different. Not a lawyer of course, but I think it would be up to Jerry Moyes to pursue action like that. Even then, the DA has the option of deciding whether or not it's even worth the trouble to prosecute.
Barring that, he could always sue civilly.Toomanybikes and FerrissWheel Thank this.
