Ta destroyed my drive train

    I recently posted a thread about u joint failure that day I did routine maintenance that day I spent $4500 on set of ten, full pm, 3 Axel alignment, and then u joint.

    I got my truck back I drove approx 5/10mi truck was driving strange I figured I just had to get used to new tires but by 20/30mi I figured out something was wrong because it felt like my truck was snaking every time I changed lanes or hit bump I stop at ta 96mi away to get retorqued they couldn't check truck no alignment machine the next was TA 190 away the whole time I drove 50/55 if I went any faster it was hard to control my truck because of the bad fish tailing it felt like i was driving on ice They were butt holes they told me it was my steering gear box and linkage it was too loose I had to call freightliner help line they told shop to check air in tires and alignment they refused called freightliner back the gave me number to closet dealership in cedar rapids ia i talked to intake officer I told him what was going on and all work done on my truck what it was doing before and after they told me to come there if I couldn't drive they would send tow truck I made it to dealership they said that the U JOINT I HAD PUT ON DESTROYED MY
    YOKE AND ANOTHER PART THEY SAID THAT IT WAS MORE THAN A 1/4 GAP OF WHERE MY U JOINT SUPPOSED TO BE that is why it was so hard to control my truck the dealership called the TA then the TA come back ask dealership about gear box and linkage being loose the dealership cut them down told them that my truck was mechanically sound the only thing they found other than the u joint damage I got crack in windshield and its getting time for brakes I provided all my maintenance records the dealership they told the TA that I kept up with all required maintenance on schedule according to freightliner the dealership told the TA is gone pay for everything they say it was simple negligence that messed my truck up they said my truck was unsafe, it is red tagged until deemed safe. they say I could have wrecked out, dropped drive shaft, etc. And before they give my truck back they are gone make sure its correct if they find any other damage because of loose u joint the TA is gone pay for that too I asked dealership can they try and make me pay Caz I drove my truck they say no Caz I am not a technician I'm still in shop I was supposed to deliver my load wed morning now I'm being charged for late load customer say load better be there Friday do the TA supposed to pay for my lost wages and hotel

    If it went that far I would check the bearings in the housing for the drive train off the yoke

    You might get lucky and they will pay for incidentals without litigation, but it is highly doubtful. Secure a lawyer now.

    TA/ and Petros, generally, are not to be trusted with more sophisticated repairs. Only tires work, batteries replacement, mounting a new mop flap, perhaps PM and brake replacement. That's all right by me, but I hate them for taking a work order that they should know beforehand that they don't have any expertise/experience about and then after an evident failure to complete the job, they will still ripoff charge you and rarely admit any wrongdoing.

    You can bet that were I in your shoes, that I would not be paying a single cent for any of it. TA should pony up for any and all expenses on your end, including proper repairs, hotel, late fees, etc. Their screw up, they are to be held accountable.

    If you fail to receive an acceptable settlement from them, go up the corporate ladder until you reach the top, with an attorney representing you if needed. They can pay for that, too. I do not expect you will need to go that far, though.

    Yup. PM is getting close to being a challenge with them. I had one last night. The fill plug for the driver had been rounded, but they didn't have one. They said KW opened at 7, and I could get one there. They proceeded to lose plug, and the plug is radically different than the one KW gave me.

    I'm not under trucks all the time, but if I were, I would have known that this was a rare plug, and I wouldn't have wasted 4 hours here.

    That is the thing about getting a lawyer, when you win you'll get that money back too. You might even get the lawyer to take it on contingency.

    You'll be wasting your time getting a Lawyer, as other than poor workmanship and some damaged parts, it's not more than $10,000 in damages, and you're lucky if you have $5000 in damages.

    You didn't get in an accident and you didn't have pain and suffering.

    If the T/A gives you problems in paying up, just take them to Small Claims Court.

    No Lawyer will take that case Pro-Bono, there's not enough money involved.

    Often times small claims court is limited to a $2500.00 dispute, maximum, though it varies by state. Strong likely-hood that this would not be accepted in small claims court.

    Personally, I would be the thorn in TA's side until they agreed to pay what is reasonable. Companies, in general, rely on intimidation and having greater patience than they expect others to have when dealing with such matters. The key is to be persistent and consistent in matters such as this. When one is in the right and maintains a persistent demeanor, one prevails. If they continually present themselves as unwilling to make amends regardless of ones efforts, then get an attorney involved. Too many people are unwilling to make the effort themselves to settle a dispute and jump straight to a hired gun, it is a sad state of affairs.

    Be an adult and get after them politely, diplomatically, matter-of-fact-ly, and determinedly. You have the backing of an OEM repair facility and presumably OEM trained techs.

    If you have a lawyer "friend" or even one just willing to write a letter....have the lawyer ask who TA's Garage Liability insurance carrier is.....and they pretty much have to convey that information when asked....then just deal with the insurance adjuster.......you have a Products/Completed Operations claim against them
