    Thanks to all of you for your comments and suggestions. We've just never had this come up before, even though we've been pulled in many times over the years and at times one of us was sitting in the passenger seat. We've been through inspections in CA (2 or 3 times), KY (twice), OR and MD and never has this been an issue. I believe that the only reason he didn't write a violation was because I had incurred well over 10 hours combination SB and off duty and would not have been in violation had I marked my log. I still haven't figured out how I'm supposed to do this while the truck is rolling so I will take the advice of the majority here and just hop back in the sleeper berth whenever we're approaching a scale.
