Who Must Complete a Log?

There are two general exceptions, as described below.

- Drive within a 100 air-mile radius of your normal work reporting location,
- Return to your work reporting location and are released within 12 consecutive hours, and
- Follow the 10-hour off-duty and 11-hour driving requirements.
This exception is optional. For example, you and your employer may choose to use a logbook even though you are within the 100 air-mile radius, so that you do not have to be released from work within 12 hours that day.
This regulation is found in Section 395.1(e)(1).

I did not find a 'SPECIFIC" LAW THAT REQUIRES A DRIVER TO "SHOW" ONES LOG BOOK. oNLY A LAW THAT MANDATES ONE KEEP A LOG. uNLESS i MIS-READ THIS.

I like the fact that DB is on this forrum, I feel it gives us clarity, so thank you DB.
1st point; the laws are the problem in the first place. By that I mean, there are just too many. Kind of like this forrum, as an example; if we just keep posting to this forrum, eventually there will be posts and threads going back years and years, that is if noone cleans them up. Could you emagine trying to find something. Laws are the same, there are laws in place that just don't make sense today and laws rewritten to enforce laws that don't get enforced allready. Somewhere, the laws got away from the Constitution and Americans just turn a blind eye because they are too busy trying to make ends meat to feed there family. If you look at the Education system and how it sucks, there is a reason for that. I don't believe it takes a very smart person to see that the Government is screwing the people and breaking all kinds of laws governed by the constitution. Surely we can agree on that to a point anyway. So my point is; we need to come together to defiet these sharks, not all of us, just a mojority. So, lets focus on that. Not argue with each other about a specific rule or regulation, they are all fubar.
2nd point; if you get pulled over by DB and your log book is not up to current you have time to get it there, from the time he tells you to bring it in to the time you actually bring it in. Now if you are missing today, yesturday and part of the day before that,,,,you deserve to be put out of service, period!

I own two motor carriers. One has the posted mc number, the other I do not want problems with. Terra Firma Freight, Inc. is the company I plan to close, so I do not mind getting it involved in a bit of experimentation. I only have on truck now under Terra Firma's authority. All other vehicles are already in the name of my other company with separate authority.
What I am going to do starting today (10/14/2011) is try my best to get DOT to ask for my logbook. I will refuse and give no reason for my action. We all know it is based on the fifth amendment, but I will just refuse, period. This should result in a citation, which I will request a jury trial be scheduled. We will go from there and I will keep you all up to date as this plays out.
I am sure there are some out there that believe I am full of it, so that is why I have no problem showing the world everything as this fun progresses. My mc number is my username and my email and phone number are listed on that book that is about "face" ---- hint hint. No posting links or emails here, but use the book to find me. My name is Jason M Holcomb and I live in Taylors, SC. Also look up my company with my mc number on the FMCSA website. You will be able to see the violation there once I get it.
I ask for any and all help or ideas on how to get my logbook requested by DOT without them thinking I am up to something.

Well let's see. Without proof of compliance via a RODS any officer will have no choice but to place you OOS. You'll have ten full hours to contemplate how to make officers ask for your book.
Good luck with the project I predict plenty of free time for ya. Wanna get asked for your book put your plate in the windshield instead of the front bumper. Completely legal but will garner you the attention you seek. -

The old "5th amendment" argument is still around, eh?
15 to 20 years ago there was some buzz about it. I even saw some "official" documents that a driver was to present to a DOT officer to scare them off. Funny thing, the truckstop lawyer who wrote it forgot to put his name and contact info on the document. Oh well, we might need extra toilet paper sometime...
Most states have a law on the books which reads similar to "It is unlawful for any person to operate a Commercial Motor Vehicle on the highways of this state unless it is equipped and operated according to Title 49, Code of Federal Regulations".
You want to drive a CMV, you gotta play by the rules.
Come in the scale without a log book and you get to spend 10 hours with us and probably receive a citation.
If you wish to "refuse and take it all the way", just know that you are by far not the first to do so. But since the HOS rules have not been rescinded by court order, you might reason that the others have not been very successful.Tazz Thanks this. -
The only way you could fight this is if you had more money than the Fed can print.
I built a home for a Multi Millionaire one time, The county wanted him to purchase all the permits and go through all the process that they set up for people to do as they please on their private property. The county started the process to shut his building down..... He filed a suit against the county with so much money backing him that the county backed down and let him build his house with out the permits.
Problem here is..... The fed is not limited to the money it can print to fight back.
