The reason for CSA

    I undersatnd this very well the rules are still the same, they have added a few though. It's just another gazillion dollar waste of taxpayers money.
    They just took the same old crap spray painted a new label on it and king ray tooted the trumpet and we now have what will make everyone safe.
    I didn't like the old system either first theres no real way to appeal or remove any derogatory information. Imformation is entered whether you are guilty or not and if you are fighting the violation or not. Since king ray has ballywho'd this so much, lots of comapnies are using it to decide if you get a load or not, how much insurance can cost you and if you are pulled in for a inspection just to name a few. Then when this data is assimulated and it won't be good we will have a newer even more burdensome system.
    There is no provision for acts of god like a bulb blowing going down the road or a flat tire, leaking wheel seal. You should know all these can happen between stops. If you do pre trip and post trip thats about all you can do. I check my truck at every fuel or rest stop too.
    Since you looked up my case info you should also know I only have 2 points on csa and I'm fighting them. I just don't like the rigged way this system is setup to obtain a desired result.
    I'm all for safety but penalizing people and taking money form them isn't going to make us safer. The first thing to make us safer is making those enforceing this system to be accountable there is no accountabilty for them and we are suppoosed to take whatever they dish out.This beyond what i will tolerate without oppisition. Anytime you meekly accept something they will only come up with something else.

    You're wrong on the Dataq's part I have a ticket I'm fighting and I asked to have it removed till case is done and they wouldn't.
    They send it back to the state and the state sends them back
    This system is really bad just like safestat.

    Just for the record as far as I know I have 0 CSA points. Well, why am I so outspoken about it? It's just wrong.

    The 5th amendment of the US Constitution guarantees that you cannot be found guilty of any violation of law without a trial, called "due process" in the amendment.

    The US Supreme court has found in several cases that law enforcement officers of any level cannot levy a fine, warning, or citation without due process.

    There are cases working their way to the supreme court against the CSA. Even though it is a civilian agency (sort of) it is recording citations, warnings, and fines on a citizen's public record. This violates the 5th Amendment if due process is not provided, as in the warnings from the LEO's that cannot be contested in any way. This has the CSA backpedalling, HARD. If you get a warning, press them, push them, keep calling them until they address the warning.

    type in your number and search it will show all inspection info in different catgories. I check mine every so often .

    The way they get around it is they claim it isn't criminal it's civil/adminstrative. The biggest way they get around it is, so few people press the issue and exercise their rights to due process.
    If everyone cited said they wanted their day in court where would the system be? Read a article in NY paper awhile back parking tickets up there are HIGH in cost. It was posted thise who said they wanted to go to court were offered discounts up tp 50% as incentive to pay over going to trial.
    If my posting influences one person to stand up and fight I feel I've done good.

    Got one for you.....

    A few years back at the Cabazon Coop (I-10 W/B by the Casino and the Rez)...there were a few dishonest DOT who were putting drivers OOS for "Unserviceable" brakes...
    The DOT were splitting the repair money with a few local mobiles from Banning and Beaumont ....
    Well a few O/O's started trading stories and they got together and involved the Feds....
    Needless to say....There's a few DOT sitting in prison along with their mechanic buddies.....

    Hey....That's human nature....Just like there's drivers who run outlaw....You can bet there's a corresponding amount of DOT who are outlaws as well....

    I know that the Trinidad, CO coop has a scam going on with a wrecking yard there...They catch 'Bedders hauling crushed cars and scrap metal to Denver every day for "being" over.....You can get the excess part of the load removed and the wrecking yard won't charge you...Yeah...."Jolly" (Those of you who run through Trinidad may have met "Jolly" before....) makes money off that scrap.....That's why he never charges to remove it off the wagon...Then he splits the money with the DOT that work in the coop....

    And I know that scale is wrong....I have been pulled in with a legal load twice and been written up for being 2000 over once....

    I showed the DOT the CAT Scale ticket and was told that CAT Scales are not as accurate as their scale is......:biggrin_25526:

    Yeah, but this is not the legal scope of civil law. Civil law is for two disagreeing parties to settle differences. If it's civil law, one should be able to sue the citation issuing officer. But wait, this isn't allowed as he/she will evoke state actor status... Thus, you will have to sue the state. Costly and difficult at best.

    It's total B.S.

    You may have to wait until the case is resolved in court...
    I know of few drivers who went to court....Faced their accuser...Won the case...and then Data Qed it....
    Sometimes the officer lets his or her pride get in the way...Then you you have go back to the judge and the judge will order the cop to remove it...

    Nobody likes to be told they were wrong...Even a cop who issued what he thought was a valid citation to a driver....
