Like I said, I swerve for them several times a year, and will continue to di so. Squaring up with a full growmn moose at highway speed, means totaled truck, and yes even semi much of the time. Now you may not have control or anything to actually control and the wreck gets worse from there.
Common sense tells me there are times to go around and times to take the hit, That common sense has served me well for 40 some odd years, I am not sure why anyone would consider swerving into oncoming traffic, or off the road if it would be a worse situation. Now I have seen moose hit and thrown over into oncoming traffic, making a bad situation worse.
This guy swerved. What would you do?

1) increase the hunting season to 365 days a year.

4) this would include wild turkeys, and most of those have 2 legs, unless they grew up new Chernobyl
5) mandatory 20 foot tall electrical fencing for the full length of the roadways

I will have to disagree, I would not have anything against increased bag limits in highly populated areas, even if using a bow was required, or increased time and bag limits in areas with dense animal populations.

I would have swerved. That moose would have destroyed that vehicle and probably killed the driver.

Situational dependent.
He could see the oncoming lane was clear enough so it wasn't much of a risk.
On a multi-lane highway I *will* look before swerving, and if there isn't time to look then I will hit.
Regardless of the situation, I will not risk loosing control to avoid an accident and hurting other motorists. If there isn't time to safely move then I wont swerve. If there isn't time to safely slow down or stop, then I will choose hitting over locking the brakes.
It may seem cruel and insensetive, but you have to look out for yourself.
If you swerve to avoid something on a highway, like an idiot on the highway cutting you off, and kill an innocent family the lawyers will come after you. The idiot may flee and without evidence you will be held accountable for the deaths. Even if you do have evidence, it may still be a hard fight because the lawyer may argue you should have hit them instead of his clients.
But conversely, if you hit the idiot and it causes you to loose control, wreck, and kill an innocent family, that dead family will be put on the idiot. In a multi-vehicle accident, the person at fault of the initial collision is also responsible for the subsequent collisions that are caused. You wont be held legally accountable as long as you did all you *safely* could have to avoid the accident and as long as you weren't doing anything to show negligence.
Animal strikes are said to be unpreventable.
Swerve and kill somebody, you are at fault.
Hit an animal, loose control, kill somebody, you wont be held accountable.Last edited: Aug 4, 2019
