    Violating California speed limit by 21 miles (55mph for vehicles of 3 axles or more)

    Thus not seeing what was in front of him in due time... If the truck was there for a long time maybe neglect of chp...

    Hitting someone in the back isn't that like 100% at fault? Or doesn't apply if you got a truck?

    How many times do we hear, if you're tired pull over and sleep.. this guy saw an opportunity and took a nap... Yeah maybe he shouldn't have, or should've picked the shoulder etc... (Stand still traffic) but to go to prison over that? Have your life ruined? Come on....

    Well, junior, I've had my Class 1 since 1982. Whatever happened "then" is irrelevant now. Traffic volumes are significantly higher. What none of the articles states is how far back the truck was stopped, nor how long after the re-opening it was impacted. I am sure that will come out in the trial as well as the NTSB investigation due out on October 31.

    This is far beyond "not doing a log correctly and falling asleep". If you think a driver like this has any business being on the highway, maybe it's time you stopped driving too.

    Have you ever seen a tractor trailer parked on the interstate, not the shoulder, but one of the traveled lanes? What do you think would happen to you if you did that?

    I'm sorry to bust everyones bubble, but the HOS violation does matter. It proves he was unfit to be behind the wheel of the truck. That resulted in the driver falling asleep at the wheel causing an accident. He wasn't over just a bit either, he was way over with days of falsified logs. No I don't think the officer has any blame to lay here. The malice is easy to prove in this case. They can't cite the bus driver or company because he's dead and he owned the company. I agree speed was a factor and I'm sure he would have been cited for such had he survived, among other violations. But the driver of the truck sleeping in a lane of travel no matter the reason for the original stopped traffic does have culpability. This is not a debate of your opinion of the current laws, that does not matter.

    Common sense on the road.... it's been missing for a long time. I'll say it again, this industry is it's own worst enemy. We almost don't need the ATA and lobbyist to push for new regs, look at the public's opinion of our industry. Maybe look in a mirror and ask yourself, how do the decisions I make affect those around me?

    It's the responsibility of the utility contractor to warn and halt and release traffic. If any police were there, it was just in a support and monitoring capacity.

    But I also never read where a cop was at the truck moments before the crash.

    This is the point I was trying to make, while Not4 trolled my posts.

    Sad part is? There is a local to me that was worse than this. Thankfully he burned himself out of it after 2 years driven and is no longer driving.

    This is just a sad case all the way around, no matter how you look at it. Let's try to remember folks that everyone involved in this crash, were/are human beings. The driver didn't choose to drive up to that construction, that stopped traffic. Sure, he broke some HOS laws and should be held accountable. How many are driving Auto's, RV's or Motor Cycles that could probably use a break? What if that truck would have been a motor home instead? We're human and sometimes we just want to take a power nap while waiting for traffic to move again. I'm sure the driver didn't want to be sleeping on the wheel when traffic started up again. I am sure the bus driver didn't want to run into the back of said truck. Why is that Commercial Bus's all run fast but I never see one pulled over? Life is full of "stuff happens" moments and sometimes they all come together at one point. Let's not judge anyone, we have no idea what is going on in their life, or was going on at the time of the crash. You know as well as I do that a story changes from one person to the next. I feel bad for all involved and my prayers go out to those that lost their life, through no fault of their own. Man, I laid down for a few winks and wake up to, Murder charges.......wtflip!?

    Actually the speed limit in California is 55 for trucks and vehicles towing trailers, therefore the bus was only going 6 over.
