Swift actually had the ability to trip lease written into thier contract.
The problem is in the implementation. Trip leasing has essentially been replaced by the broker system. Why would a carrier trip lease when they can just broker the load.

Carriers need to get out of the truck rental business once and for all. Truck leasing is one of the biggest scams ever concocted in this industry. The federal government is knocking on the door of a national AB5 law as we speak. So if this is your business model I’d highly recommend you start planning an out. When “not” if Congress takes this up in the near future the practice of truck rental/leasing is going to end abruptly.

I think this was strictly a failed "business". However, the root of the issue is leasing a truck from a carrier and calling yourself a "businessman". You start off a "business" by making a bad business decision.

Pretty much. Companies sell the own your business dream, while fueling their own. I was leased on once. Learned quickly that I was an employee owning a truck and a trailer. Not a bad deal, didn’t have to pay for liabilities or worry about much. But I know what I was and was not. Just like right now I know my business could be wiped out by liabilities in a blink of an eye.
