Time on pretrip?

    An attorney can try to use the pre-trip requirement all he wants. If you read the law it says when the driver is satisfied that the parts are in good working order. That can play out for days in a court room. There's no time limit or record requirement for pre-trip inspections. The company has added addition items on the inspection but the law is the law.

    When the person consciously disregards a substantial and unjustifiable risk that circumstances exist or that a result will follow, and such disregard constitutes a gross deviation from the standard of care that a reasonable person would exercise in the situation. Standard of care; the degree of care or competence that one is expected to exercise in a particular circumstance or role. If I disregard this standard of care causing unjustifiable risk that any reasonable person would be expected to exercise and cause injury or death it is the driver who goes to jail not management. If a driver is satisfied all parts are in good working order in 15 minutes most jury's find that unreasonable conscious disregard of safety. The corporate unwritten law of 15 minute pre-trips are to create profits and more hours of service. All the corporate surveillance systems are in place to blame drivers if there is an injury or death and none of it has to do with actual safety of the public. Truck drivers have become battered women and beat into submission.
    Been logging pre-trips 20 years 15 minutes and add P.W. for paperwork because it takes 15 minutes just to do paperwork; maps, logs, pre-trip forms, bill of laden, insurance, registration.. The actual inspection is off duty volunteer work to protect the public, plus do complete walk around after I leave and return to truck and periodic 400 mile checks. As a company driver I am aware of disgruntle former employees. ANY disregard constitutes a gross deviation from the standard of care that a reasonable person would exercise in the situation.
