Man I'm sorry about all that . I thought that I read that you were going company in the beginning and not going to do the LP . At what point did you decide to go LP I could have just missed it but thought for sure you we going CO .
Those contracts are built for the company . I would say you got a HUGE leg to stand on if they in fact stated in writing you would avg 2300 during your Lease . I hope all works out for you on all this . I knew that some where that there was a method to the madness and why folks always posted that a LEASE truck was always avaliable on the yard . With 40 quitting right along with you ( I assume a mixture of CO & LP ) that don't say much for a mid sized carrier such as ACT .
Ill stay tuned to see how it all rides out . Once again I hope it turns out good for you . My advise would be watch my DAC I had a LP go bad once and the Company ( nameless ) but that I
1. Quit under contract
2. Miss used Company Funds
Be sure you cover your bases as it pertains to your DAC . The company I speak of fixed my stuff in a settlement ( not huge trust me I'm still driving it was under $2,000) fixed my report and stated the truth about our departure which was similar to your situation . Just be sure you cover this in your method of fixing things .

Interesting story,I don't get it.My experiance has been 100 % different. There has never been 40 trucks sitting in the yard that are empty. The most I've seen has been maybe 15.I go by there once a week or so.I post my result's in motor carriers questions.Never heard of anybody being routed home every week.Story doesn't add up to me.Not calling tinman a liar, but I've had only a couple weeks under 2000 miles and that was winter and around the holiday season.I meet many drivers that have been with ACT for a long time and like it.As far as starving a driver out, that's kind of a crazy statement, what compny would do that on purpose after spending so much money to hire and retain that driver. It's very expensive to hire new people at any company, all the paperwork and man hours to proccess a new hire?
As far as getting your maint. acct. back,I wouldn't count on it.By the time the truck is detailed, serviced and released to another driver, those funds will be gone. It's a contract and you broke it.Nowhere in any trucking contract will you find guranteed miles.
I hope tinman finds the right company for himself. -
My take on it .. ( I have no. Dog in the fight ) but everyones experiences are gonna differ from good to bad . It could be where a person lives as to whether it works out or not for them as far as miles / Hometime etc .
Not everyone is gonna have a great experience , however a person should have his right to speak the truth without being persecuted for doing so . No one knows what happened but Tinman and ACT . -
If you use a law of averages in numbers lets say that there are only 10 trucks sitting on a yard on any given week ... ( just a number ) he said 40 another says 15 I'll use 10
10x 52 = 520
Take that by the # of trucks they have ( I got no clue )
Then take in consideration the amount of those 10 that are lease vs company and it won't bs hard to figure out the LP success rate at a given company . -
ACT has about 300 power units. Per the FMSCA site.

im making it barely . The saying that you are a company driver make lease payments sounds about right, my paychecks are better than company but not by much. my avg paycheck 500. a week. Looking at fuel mngment im 1 of 86 drivers in the last 30 days that got over 7 mpg . Thats based on 186 owners . I go home 4 days a month . Live ohio. Only time i see ohio is when i want hometime . I consider myself in a good freight area maybe im wrong .

If your net is 500 a week after your fixed expenses ( maybe I read it wrong ) that flat out sucks Are you at ACT also ?

It's not a story it's the truth. That's very nice of you to not call me a lier. I would challenge you to prove what you say. I have proof of what I say. I went into this skeptical. When I quit there were 46 trucks in the yard the week b4 that there were 38. So which week did you say u were there?? I have my ducks in a row this ole boy didn't fall off the turnip wagon yesterday. If u r being truthful the u r a chosen one they have to have successful drivers to sell the scam. If you haven't had less than 2000 miles a week well the that makes me wonder even more about your STORY!!

Thanks for the advice. I knew better it just sounded so good. Probably shouldn't have said anything. Just hate to see someone else get took the way I have. I have four kids worked hard my whole life and I will never compromise my values for anything or anyone. Just trying to do the right thing.
