    Not sure how it works in Georgia but in lots of places witnesses aren’t named in the initial pleadings. This is just the original filing. There is tons more paperwork and affidavits that will be exchanged before trial. I didn’t graduate the bar like you did so I don’t know where lawyers have made mistakes , but all I’ve been saying all along is if this is true it’s going to be a problem

    Most lawyers don't want their case to go to court unless they have a slam dunk for a multi-million judgement and a jury whose average IQ is within five points of the outside air temperature.
    It's a lot easier to just blow a case out with no admission of guilt, liability, or responsibility, grab fifty or a hundred grand off the table, and head for the next case.
    A couple of those a week and you have a good payday.
    Isn't our legal system wonderful?

    TMC is not publicly traded. But some of their customers might be. In this day of civil activism no company wants to have a service provider on record that could muddy a reputation

    I bet TMC will go to the mattress on this. They've already made their employees available for depositions while the plantiff has yet to sit for one.

    Correct. You did misunderstand. I said 20 years ago, I could maybe believe it. That's not to say I don't believe it doesn't exist, but I don't believe this particular complaint.
