TQL refuses to pay for delivered load !

    While I will agree that the OP made some mistakes, his company should still be paid for this load. I am quite certain that TQL got paid for this load. If they were paid for the load, there is no grounds for them to withhold payment from the company. They may withhold payment until they get paid because the paperwork was not handled properly. It is possible this is what is taking place and the OP is getting a little excited before the dust settles.

    Seems like there are way to many out here.

    Carrier is getting screwed here. A contract is in place to make sure nobody comes out on the losing end of a deal. The carrier can not come out wth less then what he went in the deal with. If the broker got paid then the carrier needs to get paid. Simple as that.

    TQL may or may not have been paid on the load. No one here knows whether they were paid or not. You assume that TQL was paid. If it were me I would have just gone back, had the pallets that were mistakenly taken off the truck at the wrong location and delivered them as agreed. TQL could have rescheduled the appointment times and everyone would have been happy. If the op was told that everything was OK with the way it was handled, TQL could be waiting to see if they are going to be paid. My guess is that if they are paid that they won't receive full payment due to the load not being delivered as agreed. There could also be penalties in the contract with the Post Office which penalizes the broker or carrier for not delivering on time or failure to deliver as agreed. If the op feels that he should be paid then he can talk with TQL and the Post Office to see if a compromise could be reached.

    Maybe this is why the postal system is going bankrupt they move freight around for free.

    Both homes are probably at least 10,000 sq ft and one is ocean front in East Hampton, NY.

    You are wasting your time trying to explain. I read your first post and figured it out, YOU SHOULD BE PAID.......
    This is the very reason fuel is high, rates are low and fmsca is like a rouge agency. All these guys are like vultures wanting to "eat their own" instead
    of going after those who deserve it. If you do a search you will find everyone of these negative posters has come here crying about some evil deed done to them
    and they want everyone else to hand them a crying towel. This same bunch will turn on anyone else who has a problem like a rabid dog.
    I guess they need validation cause they get none elsewhere?
    IF your problem was mine I would file suit in court, you don't need a lawyer. My best settlement was around 15,000 in cash,goods and services without a scumbag
    lawyer. you have several courts you can file in small claims, district, circuit and federal. The filing fees aren't that high 100-350 normally. I would send a demand of payment letter to tql and give them like 48 hours to pay and then file. Screw the bond court works better cause it can ding their credit and you can attach their receivables if you win. I would also name as defendants USPS, the dispatchers and any other person connected to the load including tql's boss.

    Not everyone who has posted has whined and cried about some wrong doing. Individuals can file suit in small claims court, but may not be able to file in other courts without an attorney. There are proceedures that must be followed and if you don't know your way around a court room, you could have your case tossed due to a technicality. The contract was not fulfilled by the op. He can file suit, but my guess is that he will lose unless TQL decides to settle the case. The guy messed up. He failed to complete his end of the agreement. If he does file and loses, he could be required to pay the legal fees and expenses for TQL.
