According to my safety department and an Arkansas DOT officer, There is no requirment that the abs work it just has to be on the trailer as long as you have a warning light that tells you it is inoperatable. As long as your brakes are in adjustment and working properly you are good to go.

Wow. I hadn't caught that one either, and I've pretty much read through the whole regs book... guess I have to go back to school... *and* start checking the "fine print" on the ABS light on every trailer I pick up and inspect. -
YES, The ABS system HAS to be properly maintained and working! I really hate pulling a non-ABS trailer in the snow and ice with a ABS equipped tractor. The company I work for is really struggling with these systems, but are taking steps and has bought the testing equipment to fix them. I think it's called the ECU sensor that keeps failing.
The Motor Carriers will get the hit on this, except the light on the trailer.

Humm, Tampering with the braking system on a Interstate Truck (felony).
Truck and trailer jack knife, kaos everywhere.. post accident inspection finds a missing ABS bulb...
now you have several felonies ....would have been easier just to have wiped off the dust from the sensor. -
