Trainer started running illegal

Good luck to you Cypher. Your doing the right thing trying to make the situation work. Remember get at least a year under your belt and then move on to bigger better things. That year may suck but it will payoff in the end.

maybe you're not reading what I wrote. where do I mention anyone's losing a license? trainee/trainer would be clearly defined in the courtroom? now YOU'RE insisting that YOU would know what would happen in court?? I'm sorry, but where on a new CDL is the "trainee" endorsement located? also, where is the "trainer" endorsement located? could you direct me to the section in the FMCSR that deals with trainers/trainees? I'm not guaranteeing that a co driver would be charged in an incident where a driver breaks the law, I'm just saying it's possible. (anyone who ignores possibilities is just not overly intelligent.) and it's NOT going to be up to your "friend who works at the weigh station." it will be in the hands of the prosecutor/judge/jury/salivating lawyer. up until 15 years ago, how many people would've believed that a restaurant could be sued (successfully) for $2,860,000.00 because a woman they served spilled her coffee? (they didn't spill it ON her, she spilled in on herself!)


as for what the codriver could do in a situation where the driver is breaking the law - your suggestions were rather silly and pointless. however, if the driver was driving illegally (ie: tired) I think it would go something like......

1)ask the driver to pull over
2)tell the driver to pull over
3)if a cell phone is available, call the police
4)if a cell phone is not available, and/or if the circumstances are extreme enough to warrant this action, then yes, physically take control of the vehicle

there is no boss in this situation, just 2 truck drivers. the only time you would have boss/subordinate in a truck is if a driver was teaming with an O/O.

 

<sigh> never mind man... you just don't get it and I'm tired of this banter. I DO understand what you are explaining.... unfortunately it is not reciprocal. If I didn't know better, I'd say you are arguing for the sake of arguing. But it is irrelevant....

Bottom line is that Cypher got things worked out.
