And you are attempting to make it less then it is! There is NO clause about within reach or sealed or not. Being on duty in a CMV with alcohol as defined by 392.5 IS ILLEGAL PER FEDERAL RULES unless you are hauling said alcohol and have a BOL. Period!

I assume you mean taking it in your cab otherwise how are you going to transport a trailer load of beer anywhere. so if a driver threw a 6 pack in his trailer no one would even know it was there.

This issue is one of those issues where there is the letter of the law and what people actually do. In all honesty in my career I have seen a truck searched by law enforcement two times. Both times the issue was dog alerts. One was on I 20 near Shreveport and the other was at the Northbound I 85 scale near Carnesville Georgia. You stick a six pack in your truck the only way your going to get caught is if something gets really hinkey really quick. However keep this in mind. If you make a practice of keeping alcohol in your truck and are involved in a serious accident and the alcohol is seen you have just opened you and the authority holder of your truck to serious legal liability EVEN if you are later deemed not at fault. Now another bit of honesty. There was several situations in my career when I kept a bottle in my sleeper. I did finally decide to stop doing it. So if you desire to carry alcohol most likely you will never get caught. The likelihood of getting caught is so low as to make a fear of getting caught almost laughable. Because of this a lot of truckers do it. Just know that it is illegal and can get you put out of service for 24 hours.
