This can be included with the OSHA case...along with back wages for you (will be figured from date of termination to the date the case if final-ed, along with compensatory wages from final case date future, since you are not in condition to work...it is called the "damages section" after the review of the case investigator and if needed the ALJ hearing.

and any settlement from the OSHA case, does not limit you to filing a civil case...hopefully your attorney has informed you of this....if not...better contact either wife or me for next step!

 

Huff: I would highly recommend that you contact an hour and wage attorney about the medical bills! you should still be able to file under workers comp. I would also think about one heck of a law suit!

I would also stop posting ANY more information on line as you might hurt anything your lawyer can do in the case. Have the mods get you in touch with Truckerswife and give your email addy. Mods I would lock this thread down and delete the thread but the cashe is still there if BFI knows how to get it. this is IMHO. Lets not give BFI any help here!

I coined the phrase a few weeks ago and I now authorize by any driver or poster to TTR or any other forum the use of BFI for any company that becomes a BFI company.

BUT! USE CAUTION when calling a company what they really are, a BFI ,as they will get their widdle feelings hurt and try to sue you for calling them a name, but as we were all taught in kiddie garden "The truth hurts doesn't it"!

Besides if they didn't pay you what will they get out of you?

Hi Huff, one word of warning. The wheels of justice turn at an almost standstill, so don't expect too much for a time. Of course, being from the south, you might just get a more "timely" investigation from OSHA. Good luck to you. I support your effort in obtaining justice for you (the truck driver) and your wife. More should be doing this who have found themselves on the short end of the stick with their employer. Make them accountable for their actions.

 

You signed a wavier for your wife to get on the truck so how you gonnna get the medcial billls paid for her?, Also you seeemed fine at the yard whinein and crying over every lil thing. You cryed about every load, nobody forced you back in the truck you, that was your choice.
