Hi, as an owner of a truck I have a driver. We go 50/50 on loads & fuel. I pay tolls and scales and misc. He was recently in a roll over accident caused by speed and he was carrying a load. $440 was put in fuel for that load. Now the truck is totaled. Should I deduct the $440 out of his pay or go 50/50?

you have other more important things to discuss rather than punitive damages such as Fuel Lost..
Shouldnt you be more concerned of the well-being of your friend/Driver?
Your not going to be able to Snap your finger and Make a New Truckl appear along with a safe/healthy Driver
When you file your claim with your insurance for a complete loss...Make sure you Tell them you Had $440 in Fuel too, Maybe You can Get a Bigger CheckLGarrison Thanks this. -
You need to pay your driver in full and thank him for all the good work as you walk him to your car, load all his stuff in the trunk, to take his last ride home from you.
This is the fun side of owning a truck you pay someone else to drive.

If the initial agreement was 50/50 on the fuel, then that's they way it should work. Had there been no such agreement, then obviously you wouldn't charge him with that. The company would absorb that cost as"the cost of doing business". He agreed to that just the same as you did.
In other words, you didn't have an agreement to pay half the truck payment or half the maintenance, so he doesn't owe you that. but he did agree to half the fuel. He owes you that. Its an agreement & an understanding from the initial employment.... as a condition of taking the job.
