Trucker files request for personal exemption from HOS rules

    "Leland Schmitt Jr. is an owner operator leased to D & E Transport in Clearwater, Minnesota and has been driving for 30 years. He is requesting a five year exemption from the 10 consecutive hours off duty requirement, the 14 hours “driving window,” the 30 minute break requirement, and the 60 hours-in-seven-days and 70 hours-in-8-days-limits."

    So he followed those rules for 30 years and now, after 30 years, they all of sudden don't fit his sleep schedule?

    Or you can read the request. I know it's effort but you will look much less foolish if you do.
    He never admitted to breaking hos. He does, however, use exemptions frequently.
    Covid, emergency, oil field, ag, etc.

    They don't fit most of our sleep schedules. He's not unique in that regard.

    It can be implied that he was breaking the rules for 30 years.

    What I look like is irrelevant. The issue exists whether I do or not.

    Why didn't he apply for the HOS exemption 30 years ago? Why not 20 years ago? 10? 5?

    Maybe the only reason he wants the HOS exemption is because of his pesky ELD on his dash instead of a number 2 pencil.

    I just did.

    Why would he wait until now to apply for an exemption from HOS rules instead of some time before on his 30 year career?

    Because, like he said it you wound bother to read his request, he worked ag exempt, disaster exempt, covid exempt, etc....
    There are plenty of legal ways to run like he wants to, and when he can he does. He just wants to do it all the time except only when he can.

    So, care to answer the question? Where did he admit to breaking HOS?
