Trucking industry digs in for new HOS battle

"The ATA posting noted that under the terms of a settlement with Public Citizen, the FMCSA has nine months to review its current rule and submit a notice of proposed rulemaking on the issue, and up to 21 months to issue a final rule to replace the current one. The government just trying to do what they always do!! Attempting to fix something that isn't broken. Personally I still don't see what was wrong with the old rules that were in place for decades before the 2004 rules.

 

Me either! Just the government trying to stick it to us anyway they can.

 

now to each his own but im not going to dig in , im going to do what ive always done turn and burn, im out here to make money not play patty cake with the DOT,if they cant figure out the HOS how do they expect any one else to know, beside i know when im tired and need to rest and when im tired i get the rest i need i dont need a momey to tuck me in.

been doing that very thing for a lot of years aint gonna change now and you rookies can run your mouth when youve lasted as long as i have dont think your gonna make it.

BUT thats just me and my way of doing things and i never made a dime from the DOT there just another goverment ####### trying to get mine and your money and most of them dont even no how to spell safty.

Statistics can very deceiving because the decrease in accidents didn't start showing until the gas prices went sky high. People were not driving and buying as much and that is probably the real reason.

 

Actually that is not true.
These rules came in, at the end of 2005 which was the the highest crash year ever for deaths.
Since 2005 the numbers have gone down every year.
The number of trucks on the road went up every year till 2007. At that point the fuel issue really became big and some smaller company's went under. The same quantities of freight were still moving till last year though. When tonnage really dropped.
We still have as many trucks on the road as we did in 2005 though. Which was more than ever before, running more miles than ever before.
Also remember that most of those accidents are the result of 4-wheelers negligence. Not truck drivers. Yes, a truck being involved in an accident raises the chance of death, but in most cases the accidents are not the fault of trucks.

 

Hey yall.
Just heard recently that the current HOS are under review again. When will they make up there minds?

As a modern day trucker, no offense to the old timers, they current rules are the best and need to stay that way. Plus the whole idea of getting rid of the 34hr restart does not make sense either. Doing so, I believe, would give drivers even more incintive to drive illegally and as a result make driving even more hazardous and make our image more and more ruined.
In my opinion keep em as they are and make the law tougher on companies that regularly force their drivers to go over the time limits. A load is not that critical to drive illegally while safety is a concern. (example: A load deemed critical p/u at 0800 say at abc company and the driver is told that it "has" to be at fgh company by 2330 that night. The mileage is 800mi and the driver will be running into a severe blizzard along the route. you understand what I'm getting at? Prob#1 the 11/14hr will be in violation, prob#2 a storm is approaching along the route, prob#3 it's the miles, and prob#4 your dm says you have to do this load or your fired. Solution, take the load, but get there within reason and call ahead to get schedule change for the next morning, and tell the dm that he can fire you becuz it, being me, I wont run that fast and as I was instructed during training that if the road conditions are not what I deem safe, I will pull off the road and wait till better arrive. Also, I stick to the book and those of you who have an issue with that sorry I cant please everyone.)

If someone is reading this and is confused, a little explanation. 1, Follow the law. It will keep you out of trouble as long as you do things right and don't cause problems. 2, driving over hrs is against the law. Do I need to repeat myself. 3, Just becuz everyone does something does not make it right to do it yourself.

Ok enough of my small talk, lets hear what everyone else has to say about the issue and keep it nice. no bickering or trash talk.

I would suggest we utilize the same HOS as Mexico.....Oh wait...They have none......

 

They are being reviewed because that's what the Teamsters want and they made $20 million in campaign contributions in 2008 including $5,000 to Frank Lautenberg (D, NJ ) who pressured FMCSA the hardest for a review .
And for you OOIDA members OOIDA approves of the regs being reviewed because they want to try to get the old split sleeper rules back . Ain't gonna happen . Public Citizen will not accept any break under 8 hours as off duty .
