[FONT=Arial, Helvetica, sans-serif]Coverage under the [/FONT][FONT=Arial, Helvetica, sans-serif]Most jobs are governed by the FLSA. Some are not. Some jobs are excluded from FLSA coverage by statute. Other jobs, while governed by the FLSA, are considered "exempt" from the FLSA overtime rules.[/FONT]
[FONT=Arial, Helvetica, sans-serif]Particular jobs may be completely excluded from coverage under the FLSA overtime rules. There are two general types of complete exclusion. Some jobs are specifically excluded in the statute itself. For example, employees of movie theaters and many agricultural workers are not governed by the FLSA overtime rules. Another type of exclusion is for jobs which are governed by some other specific federal labor law. As a general rule, if a job is governed by some other federal labor law, the FLSA does not apply. For example, most railroad workers are governed by the Railway Labor Act, and many truck drivers are governed by the Motor Carriers Act, and not the FLSA. Many of FLSA exclusions are found in §213 of the FLSA.[/FONT]
As a postscript, the Motor Carriers Act basically says that OTR carriers can screw you and not get Rodney King-ed by the Fed's.
Prior to July 1980, all the large trucking companies were highly regulated by the Interstate Commerce Commission (ICC). Trucking companies applied to the ICC for routes to operate along, the highways they could transport freight on, the cities that could be used and so on. This operating authority was carried on the books at a high cost since only a few competitors could used the same routes.
In July 1980 Congress passed The Motor Carrier Act, which deregulated the trucking industry. The operating authority became worthless since anyone could start a new trucking company and operate between any city they wanted and use any route desired. The old common carrier business changed overnight. Instead of taking freight collected from one city to a terminal, loading it on a trailer destined for the same destination with other freight going to the same place, now companies filled up an entire trailer of goods going to just one place. Hundreds of large trucking companies went out of business in just a few years. Names like McLean Trucking, Branch Motor Express and Associated Transport were replaced by Swift Transport, Celadon Trucking and US Xpress. Thousands of people lost their jobs because of The Motor Carrier Act of 1980.

The Motor Carrier Act of 1980 seriously overhauled the industry. It opened the door for rock bottom freight prices and sleazy brokerages. Since the act went into enforcement the ability to become a company owner indeed became easier, however the industry has been so saturated with bad companies that the entire industry looks crooked. Even the companies seem to have lost respect for certain aspects in this industry. Ethics was lost with the Motor Carrier Act. What brokers have done is nothing short of a sin, not just to trucking companies but customers as well. Companies are now willing to haul cheap freight throwing all quality and industry standards out the window. There is now a lack of pride and continuity in the industry
Basically Jimmy Carter with his pen in hand transfered power from the trucking company's, to the shippers and turned the trucking companies into a bunch of thugs who fight over who can do it the cheapest to force the other guy to sell out to them or go broke. And then walla, you have SWIFT.![]()

Us Express, well their lease program needs a lot of help, but mind you one thing, these people " do not care about you" Listen up drivers, this is not the place to lease from, nor is National Carriers, Liberal KS. aka " Elite Fleet" nothing elite about them either,
so problem #1
They have a worthless Occupational Accident Policy aka to them as they try to sell it " Workmans Comp " do not get hurt here. You will find out they do not care. Ask first for the hard copy of what this Insurance really does? These policys are made for their own protection, most states should " out law " these rip off policys, you spend money on it then " fight for the coverage" when you need it. Footdragging, don't call us, kind of attitudes in the home office of Tunnel Hill Georgia, only suspends the final outcome from the " Good ole' boy" buy from us we'l screw them later, don't pay a thing, keep them on hold waiting for a Doctor referal, forget it US Express has the worst Work Comp policy available for top dollars. ( But its not workers comp) You can not get the Insurer to pay for the doctors, or give the doctor referals you need a " return phone call" The Attorneys won't touch these policys. Why you ask " there is nothing for them to go after" Great West Risk Management needs to be investigated by the FBI or the Tennessee Insurance Commission for running the biggest insurance scam in the country. Try to get this carrier to pay for lost work. How about light going off due to no pay, who do you see then, screw this Company and their sorry insurance coverage for the workers,

try to get downtime pay for a truck you leased then goes in the body shop for weeks. NO says Great West, we do not pay anything unless the truck has been in the shop for two ( 2 ) weeks then its' $ 500 a week after the 21st day. What sorry person found this Great West Company over writen by the " Old Republic life insurance company" Who in their right mind is going to sit for a month waiting on a downtime check tha amounts to nothing. My expierence is if your hit by another trucking company ( while parked ) and they are responcible for your lost wages. No they are going to suck up any funds you are deservent of and you will know nothing about it. Yes my fellow drivers the Lease payments build up and up while you sit waiting for " nothing" the " fat Cat " on the hill in his " Brick Building " is screwing you as best he can. No more need to be said about him we all know who and what his is.
Ok # 3, try to get paid for waiting 30 hrs at a rail yard. You will never get paid for it. NO! NO! NO! DO NOT TAKE A RAIL YARD PICK UP,, they should have shipped it by truck!!! Well I guess its' truck train??/ Who ships a load by train.. AHHHHH.. No more said here either..
US Express you need a wake up call, one of these mornings all your drivers are going to be gone and no one will work for you because they all are reading these blogs that speek the truth about you company.

I am looking for some answers on this subject. I'am not a driver for U.S. Xpress but here until recently ( January 30, 2009 ) I was a mechanic at the Medway, OH terminal for 4 1/2 years. When I showed up for work on Friday, January 30, 2009 all started normal. Then within the first half of an hour of our 7:00 a.m. start time, management started walking into the office ( one by one ) and "laying us off" indefinitely. We were told that if things got better we could always reapply at a later date.
My friends this did not just happen to me!
I had watched our shop go from a decent crew to nothing in 4 hours! My shift was Wed-Sat and when we started that day we had approx. 25-30 techs working that end of the week. At the end of the day there were 8 still employed.
AND THERE ARE MORE LAYOFFS MONDAY MORNING 02/02/09!!!!!
We went from job security to unemployed with NO WARNING.
Our management in Medway knew nothing about this either. There was a e-mail sent to management # 6:00 a.m. that morning, they don't arrive till 7:00 a.m. The e-mail had our letters of layoff along with a list.
Later that day I got word from my friend that works second shift that while talking to a driver whose truck was in the shop ( just after he was canned ). The driver stated that they just last week layed off half the OK city terminal shop employees. I'm unsure how true that is however, if anyone has any info it would be greatly appreciated by me and my colleuges whom feel betrayed.
As soon as anything happens Monday I will post it. Any relevant news, info, etc. regarding what is happening to u.s. xpress and/or Medway terminal would be greatly appreciated. Thank you for your time. -
Wish you the best of luck and sorry to hear about your layoff. Been to Medway with hubby. Was broke down for few day. Management there sucked. Unfortunately were under the lease program. Lost everything we had in the short few months were with us slave xpress. A trucking company dedicated to opening their arms patting you on the back to get the slaves in the door and to hell with you(YES SEREE SIRRRRR....WHATEVER YOU SAY SURRRRRRR) sURE ENCOURAGE DRIVERS TO MAKE THEIR TRUCK PAYMENTS FOR THEM. tAKE CARE DRIVERS GOOD LUCK TO YOU BUT THIS COMPANY IS ALL EVIL................

I worked in a union company, and I don't care for unions. But they server their purpose with companies like this, because if you don't have a union to represent you, your screwed.
In my opionion were headed back to the days of Unionization, and it will be us versus them (Sigar smoking big boss types,) working for big companies that don't care for the employees. Hello WallMart!
So (and I can't believe I am saying this) maybe you guys should start to try to unionize. That will scare the crap out of them!
Please don't get mad a me for suggesting that! But the union will protect you.
