Understanding Speeding tickets?

    Why not just ask the court for deferred adjudication, if the judge will allow it, you will have to plead no contest and still pay the fine, but after a short 2 to 3 month probationary period the ticket will be dismissed and you will legally be "not guilty" of the ticket. It's a pretty common way of keeping tickets off your record in Texas.

    Texas law also allows you to do the Driver's Ed thing (once every 12 months) to get a ticket dismissed. And the Driver's Ed ticket dismissal deal is not up to the discretion of the Judge, it's a state law that requires the court to allow you this option.

    Unless things has changed, CDL license is exempt from taking Driver's Ed or Defensive Driving. This from my understanding is regulated under Federal Law which trumps State Law.

    § 384.226Prohibition on masking convictions.

    The State must not mask, defer imposition of judgment, or allow an individual to enter into a diversion program that would prevent a CLP or CDL holder's conviction for any violation, in any type of motor vehicle, of a State or local traffic control law (other than parking, vehicle weight, or vehicle defect violations) from appearing on the CDLIS driver record, whether the driver was convicted for an offense committed in the State where the driver is licensed or another State.

    If you want to drive a truck for a living,

    it is best to fight any and all tickets you receive.

    Is a clean license not worth it ??

    So even though the ticket was issued to a person while driving a personal vehicle with a standard Class C drivers license, the fact that they have a CDL will bar them from deferred adjudication and/or drivers ed?

    Yes, the hold a CDL... the same way that some drivers STILL come in to apply and swear that they have a clean driving record.. when the check comes back.. they try the "it was in my personal vehicle so I didn't think it counted" excuse.. You only have one driver's license.
