Like @buddyd157 said. It's your job in a cmv to drive for everyone else on the road, you are the professional. Your story changed from you had just put it in drive straighting the wheels out to you were doing 15mph, you admitted to backing out of a driveway and we're cited for it, you may have been on the double yellow? Everyone is correct in saying you should get a lawyer asap and try to fight this. I personally wasn't there but given what you said.....not good. I do wish you the best with it and hope you can take this and learn from it. Other thing I didn't bring up but I might as well now is what business did you have in that driveway? Did you have a call there or just turning around? Private property is a no no unless you have business there, I drove a package car for 10 years (same size as your tow truck) and seen more property damage claims that I can keep count of from drivers on property they had business with let alone ones they didn't. Why do you think we are always stopped in the street? Get a lawyer, fight this all you can to protect your license, and please please please think about all this and learn from it. You are supposed to be the professional here.

Depends on the state.
My state is simple, if she had her overhead lights on indicating a hazard, the other driver is at fault for hitting her. This is important because the law is clear about the right of way for assistance vehicles.
Maybe most other states that have the move over/slowdown laws would also back the tow truck driver up in court, seeing the other driver lost control, even if the truck was in the middle of the road.Badmon, Sunshinegirl and TripleSix Thank this. -

I am in Idaho. I had to go back for contact info on a tow I had just finished. It absolutely is my job to drive for everyone else and be as safe as possible. But I can not control her coming down a hill. Traffic was clear on both sides I had my lights on so I went. She came flying down the hill had seen me at this point in drive going 15mph and lost control. It was like watching a snake.

As I had said earlier from the top of the hill to where she saw me she had roughly 400 ft. when she locked up she was in both lanes and missed the front of the truck and hit the back. My job has since then posted a position available so I believe I am going to be fired. Thank you everyone for your suggestions

This is what is says I'm regards. I was always told to have them up with poor visibility and turning around in case I am blocking traffic.
