I have absolutely no problem with the court system, that is the District Attorney, the defendant's attorney, and the judge, after conferring with the victims for their input, in changing the sentence to something all parties can agree on.
That is the very essence of how the legal system should work.
Not with some petition electronically signed ( and therefore unverifiable) by individuals with no direct knowledge of the facts in the case.Bean Jr., homeskillet, drvrtech77 and 7 others Thank this. -
personally, the sentence was given, and it should stick.
until such a time, new evidence can be introduced at an appellate court.
otherwise what does it say if a judge rescinds his sentencing?
says to me, that judge needs to be removed from the bench.
the judge could have taken the prosecutor and defense counsel into chambers to discuss the sentencing to be handed out, unless that was already done.Rubber duck kw, homeskillet, Midwest Trucker and 2 others Thank this. -
110 years did get an eyebrow raise but he made choices that killed people and injured many others. He could of prevented this but chose not to, no pity here.
The very first thing that was taught to me when learning to drive a truck was to ask myself before putting it in gear in the morning is "Can I end my life to save others today." If the answer was no, clean out the truck and go home.buddyd157, homeskillet, Badmon and 2 others Thank this. -
When the judge handed down the sentence, he made a comment at that time that it was not the sentence he would have handed out given the circumstance. He was bound by state minimum sentencing. He suggested on appeal, that the defendant could ask to serve the counts concurrently.
Not taking a side, just pointing out what the judge said.Bean Jr., buddyd157, homeskillet and 8 others Thank this. -
Also keep in mind the moron was given several chances at a plea deal and refused anything but a traffic ticket. He got what he deserved.

The company and the idiot who gave him a license should also be charged. He can’t even speak english, how can he read the signs and rules? Putting him in a truck and sending him down such a dangerous road with no idea what to do was a recipe for disaster.

Myself and others on this forum have said this before. I wish there would be an investigation on how he obtained a CDL. He's off the road now but how many others like him are still out here with us.

Actully it was proven he CAN speak and read english quite well. Not at a lawyer speak level perhaps. But certainly at a conversational level.501knight and bryan21384 Thank this.
