    (2) Emergency conditions. In case of any emergency, a driver may complete his/her run without being in violation of the provisions of the regulations in this part, if such run reasonably could have been completed absent the emergency.

    So I think he's good isn't he?

would depend if he could have finished his run in the allotted time.... But, I think that is in regards to delivering freight... if rest area's and trucks stops are available he could have pulled off before running out of hours...

    would be a tough question...

I wonder. If you are stuck in a massive traffic jam, and it is NOT moving at all, can you go to "on duty not driving?"

Legally, no. My elogs does it automatically and I can't control that. Oh well.

    Edit:

Legally no if you are controlling it. I suppose if you set the brakes and move out of the driver's seat you can do that.

My Qualcomm does that automatically, but it doesn't change the 14 hour clock from ticking...

I realize that with the 14 hour clock. I was talking about driving time limit.
So I guess now that you mentioned it, just what do you do, if you are held up past your 14, past the two hour emergency exemption?
You supposed to just shut down right there and take your 10 in the granny lane? (a bit of humor there.)

The two hour doesn't even extend your 14.

Twice I've been close to my destination, less than an hour left on my 14, and had a breakdown that left me on the shoulder. No choice but to violate HOS, but with a note in the logs, I can't imagine I would be ticketed for it.

The one time I've had to use it I just stopped at the next truckstop instead of the one I was planning on. Better safe than sorry.

Precisely my question! WTF do they expect from us?

And, while we on the subject, can I just say how much SAFER I feel, sitting here on top of a snowy mountain, waiting out the next few hours while it gets colder and icier before I then drive down it fully loaded, all because someone decided I simply must be tired by now?!
