    Xactly...What are the options?...
    1. "as fast as I thought I could go without drawing attention which obviously failed" and admit guilt
    2. if in a 55, '58 or 59' and admit guilt
    3. "no" and admit you had no idea what you were doing and that he could be right
    or, and as nicely as possible
    4. "I'll exercise my 5th amendment right"

    Number 4 is answering the question...

    As a trucker, your amendment rights are severly limited. Refuse to cooperate with authorities and they will just place you OOS.

    The 5th amendment applies to court trials/interrogations. A LEO will NOT ask you any questions regarding a case until you have been read your Miranda Rights. If you note the first line of the Miranda Rights, it states: "You have the right to remain silent". Being silent isn't going to stop a LEO from making a arrest and pressing charges.

    Be professional and polite and say I'm not making a statement under the 5th amendment sir or ma'am. Just remember the Officer will then try to engage you in conversation not related to the issue and then attempt to redirect it. Or become very agitated with you and try to provoke you.

    Your driving privileges are or might be limited but your Rights under the Constitution are not.

    An Officer asking questions pertaining to log book entries could become criminal depending on what is said or discovered during the interview/interrogation during a road side stop.

    WOW, just wonder how some peoples records are?, I've been stopped many times, and always answer the LEO, 99 out of a 100 no ticket, People that irritate leo's IMO, are the reason we have LEO's with attitude, They have a high stress job, and dont need any CRAP from you, BE polite, repectful, and chances are, you be fine, Dont talked to LEO's?, I will always!

    The commerse clause says otherwise. Our rights under the constitution are limited, like it or not. We don't have free speech, we don't have rights to privacy, we don't have rights against unlawful search, etc. You're driving a CMV on a public road across state borders. You have no rights. Only when you are arrested for a crime can you exercise certain rights. Not before hand.
