He should have NEVER been in that semi then. Much less a Trainer. Or even a employee. In fact touching a big truck with nothing in his wallet? oh boy.. what did they do? Make him sign a frigging passenger waiver making YOU the top dog in that truck?

yeah ive been writing it down, i have emails like i said with dates and times, my log book in his hand writing and proof...

my main concern is me. from a legal stand point they are training me wrong and illegally and i almost feel like i have to comply o im SOL... so as a big company who violates these laws and forces their drivers to do as they say there should be some easy way out... my friends recommended a lawyer but my concern is since i was the one driving it would be MY fault? ... even tho this company told me to do so?

from what i gather he had a class A and he was unable to maintain citizenship or a green card ? So he lost it, and still does not have any license what so ever - which i found out several hundred miles into the trip

You might have some gold here.

Hm. Get yourself a lawyer quietly. Tell him what you know quickly before the oppertunity slips away. If your lawyer knows anything at all about Trucking and Citizenship Laws...

You did not hear it from me. I don't even want to come back to this thread. Your stories are getting pretty... outrageously close to some of the yarning at the lunch counter....

There are no laws or regulations pertaining to any standards by which a company "trainer" must meet. If you already hold a valid CDL, then there is no requirement for the trainer to be licensed...provided he does not do any of the driving. As for the other alleged violations, were they REALLY safety-related violations? Or were they merely things you noticed that you didn't like the way they looked? Granted, you are the only one who should be drawing lines in your log book, but some of the other things may not be an issue. For example you said mudflaps, so we'll run with that example. The truck doesn't have to have ANY mudflaps on it, provided you are hooked to a trailer. Even then, whether or not you have mudflaps is a state-by-state issue. In any case, only the rear-most axle is going to be looked at. Some states want those mudflaps to be within a specified distance from the ground. Other states have a formula to calculate the angle from the contact patch of the rear tires up to the lowest portion of the vehicle behind the axle...fender, etc...and the farther back from the axle that might be, the higher off the ground it is allowed to be...which means that in some instances, mudflaps may not be required at all on those vehicles.

So are these "violations" you are claiming to exist REALLY violations? Are they merely cosmetic with no affect on the safety of the vehicle? Or are they safety-related that could have you placed OOS by an officer?
