Perhaps although that's up to the US consulate officer to sus any documentation out when the applicant applies for their visa, or the USCIS if the applicant is already in the USA and applying for a change of status. One of the reasons the new Trump government has been clamping down hard on visa's issued may have something to do with what you've mentioned though, with immigration law you are guilty until proven innocent so persons arriving in the US on a visa would be either guilty of being an intending immigrant until proven otherwise or guilty of miss using their visa, either way they are required to prove they are a bona-vide entrant into the USA. Ultimately CBP have the final say as to who can or can't enter the United States.
