It’s not just trucking, this would be a huge disruption to the country. Nobody could be an independent contractor. Traveling nurses? Not anymore. Freelance writers? Not anymore.

Right on. You've found a model that works well for you which is great.
I don't do well as an employee either. Having someone tell me when and where to go, what work to do, how much time I get to take off... ugh, talk about soul draining.ProfessionalNoticer, Speed_Drums, dwells40 and 4 others Thank this. -
Freight moved before 1980 deregulation and still does. Most say it was better and I have seen one individuals records to prove it. It eliminated huge tax "burdens" on companies and lowered overhead. Changes are bound to happen, freight will still need shipped. It will still get shipped. They guys that went to Washington asking for the Gov. to regulate rates and control brokers are the same one who pushed for deregulation. How about now, 12 months later the rates are the best I have ever seen. What if the got the rates controlled, would the be back asking for more? Were are they now?
I'm currently independent, but you never know what could change. I'm interested in the subject but maybe have a different perspective.
If your under forced dispatch, your a employee. If you don't have control of equipment your a employee.
Last, if you drive a truck that you do not own, you should be classified as a employee.
That 1099 Chicago truck pays zero employee tax. They are in competition with me. I pay my employee contribution.
Now I understand that the 1099 driver only must pay the same percent as me, but the driver is not my competition, the Carrier is my competition. I say F them. Let them get hurt.
It would force Co. To pay driver wages and 50% of driver tax liability. Opens up options for company sponsored retirement.
Mega corps have done nothing but try and relief themselves of responsibility. I do hope this hurts them.

Just look at the construction industry. There is usually a general contractor that contracts out the plumbing, electrical, dry wall, painting, carpentry all to individual contracts.

I agree with you fully, that if you don't own the truck, or at least have full autonomy over what work you do, then you're an employee, and should be classified as such.
Those of us leased to companies like Mercer, or Landstar and many others, we own our trucks, we choose what work we will do and are generally left to our own devices.

But those contractors are able to move from builder to builder to get work. If you're running under ones authority you can't go out and get your own loads(work).gentleroger, singlescrewshaker, Speed_Drums and 2 others Thank this.
