    Laws govern contracts now, & no contract is written without taking current laws into consideration. The law doesn't say you can't go into business with someone, but it does set regulations as to who is considered a contractor. I haven't formed an opinion one way or another on the law, but keep in mind laws are written as a result of past behavior, like companies overstepping the contractor relationship, disgruntled contractors filing lawsuits, people trying to circumvent tax liabilities, & people trying to circumvent regulations. But again, I really don't think it has a shot at passing.

    Just got this email from OOIDA, this Bill is in motion and needs us to stop it. Write or call today, there is no time to waste.

    The House Transportation and Infrastructure Committee will be meeting tomorrow June 9th to make changes to the House Highway Bill released last week. OOIDA will AGGRESSIVELY OPPOSE the legislation until the proposed insurance increase to $2 million and several other anti-trucker provisions are removed. As part of this effort, OOIDA is supporting Bost Amendment #184 to strike the minimum insurance increase from the bill. We also anticipate additional amendments to eliminate anti-trucker sections of the legislation, including:

    • Section 4202 - Returns CSA scores to public view within a year
    • Section 4306 - Directs FMCSA to revise the agency's personal conveyance guidance to set specific mileage or time limits
    • Section 4308 - Initiates a rulemaking to establish screening criteria for obstructive sleep apnea
    • Section 4311 - Expands FMCSA use of ELD data
    • Section 4404 - AEB mandate
    • Section 4405 - Potential front/side underride guard mandate

    How does it address it? I own my equipment, I’m allowed to do what I want (I receive no dispatching from the owner of the authority), but because I am leased to a carrier and the billing goes through them that makes me violate part B of the ABC test.

    Trucker could be the most powerful political force in the nation if they would just stick together.

    Let it be known that whatever person voted for a bill you warned them not to vote for, then not one truck will pick up or deliver in that congressional district.

    no gas, no food, no packages, nothing .

    Id know why you guys think it matters were freight comes from or who its brokered thru. Has zero to do with this.

    Your leased and operating under ABC trucking. Your under ABC scope of operation. Sure you might be able to drum up your own customers, pick your own load, or brokers. ABC covers insurance, billing, and pays you. They broker doesn't pay you. They pay ABC. But your leased to ABC. You are a agent, or contractor depending on your equipment lease.

    Now want a thought. You do all the leg work, own and drive the truck. But because you hunt and find your own freight, ABC can have one less employee and still take that 24% or what ever you agreed to. You just did 90% of the work. Of fricken course they will let you do it.


    Now if ABC allows a Trip lease, or you to actually be leased to another carrier at the same time. You must spell out dates and time in agreement. It stops ABC liability while your hauling for XYZ. But you now are under XYZ's scope of operation. Name on truck must reflect it. You are free to do this. The only time you can not is if you agreed not to in a lease agreement. But its all company policy. Not law.

    Plus most agreements allow either party to terminate lease at anytime. No one is tied to anyone.
