I really can't believe that a school would teach such a thing. So you're basically telling the judge that you had to push the car out of the way because I didn't have enough clearance for my truck!! Every truck is required by the FMCSR to slow down and look before crossing and you do not cross until you can be sure that the course is clear. Show your instructor FMCSR §392.11.

If a car cut in front of you after you've made the check you'll need to be prepared to go to court and hope you have witnesses to support what happened. I would say be prepared for that to happen and stop behind the line. That's what we do even with a stale green.

When i was in school we were taught to Look ahead so you know what is going on so you can make a plan for it. Sounds to me like this guy is basically teaching them how to get into accidents and get fired in my opinion anyway. You listen to his advice and you better have a good layer!

Common Sense Rule applies here folks.
80,000 lb Truck versus 1millionlb train,
Second instructors are usually people who could not hack it on the Road, once you have your CDL it is your responsibility to Drive your Truck Safely and Responsibly. It is your CDL not the Instructors, Not the Travel agents( dispatch) and Safety only cares about a low SEA rating. So Do yourself a favor READ the Laws, Study them, Drive Defensive all the time, and NEVER NEVER take someones word, find out for yourself.

He used to instruct for schnider and now works at a school in oregon. I won't write his name here out of respect for him however I'm telling ya pretty much as he put it.

It made sense however I'm finding myself ( now that I'm driving semis ) that I don't care how many cars behind me I'm pissing off, I won't cross them tracks until I know I can clear it.

However if a car DOES cut in front of me and stops I will be blasting my horn to no end until they move. If a train DOES start comming and its a choice of face a law suit or see my load crushed and possibly my truck...

I'm pushing them gently out of the way.
