Actually an executive order in July 2016 by a certain individual instructed federal agencies to disregard the out of service criteria
Was never intended to be an oos violation. That came later with CVSA assuming it was what fmcsa wanted it to be. You can lead a horse to water….
As should’ve been done. Fmcsa dictates what the regulations are not the CVSA independent agency. You can bend your knee to the foreign agency if you want
Yes we all know how eager and emotional you’re on the subject, Was just Las week or so that you posted about seeing a driver at a scale getting the English language test. Made me laugh because the law hadn’t even taken affect yet. Just as I replied to it you immediately deleted it. Guess even you noticed how stupid it was, lol
In 1936, the Interstate Commerce Commission (ICC) established a minimum English language proficiency requirement for truck drivers operating in interstate or foreign commerce. This requirement stipulated that drivers needed to be able to read and speak English, understand traffic and warning signs, and be able to respond to official inquiries. The ICC's Motor Carrier Safety Regulations stated that after July 1, 1937, drivers had to meet specific qualifications, including the ability to read and speak English. This regulation was intended to ensure drivers could understand traffic signs, communicate with the public and officials, and accurately complete reports. The ICC believed this proficiency was essential for compliance with safety regulations. While the requirement was initially aimed at ensuring safety and effective communication, there were later clarifications about how it would be enforced. The Federal Highway Administration (FHWA) clarified that the motor carrier employer was primarily responsible for assessing a driver's English proficiency, and the regulation was not intended for roadside enforcement
Wow, this topic has given me an incredible, profitable idea. I could work something out with The TA /Petro’s that have the church trailers..God’s work so to speak. Set up English lessons for truck drivers in need…Charge them dearly of course. I would make sure it’s proper.. I could fly in some “folks” from England to do the teachin part. Within just a few months we’ll have every Mexican driver speaking the Queen’s English. I know some of you will laugh but I guarantee you that I could raise millions for a startup
