We're to go from here?

    Was in truck crash and taken to the hospital can't remember what happened just remember bits and pieces of the accident no other vehicles involved and know one else involved thankful for that but now I don't know what to do went to work comp doctor they are sending me to neurologist for evaluation . My problem is the drug test when I showed up at the workers comp doctor they said that I didn't have to have a drug test so I went and used the bathroom then when I was taken to the back to see the doctor they wanted me to give a UA but I didn't have to go so started drinking water Then the phone rang and I not thinking stepped out of the office to answer it in plan view of the desk never left the side walk I never left the view of the office.They called the company and said that I refused to take the test.But I didn't refuse and didn't say that I would not take the test.In the mean time I was told that I would have to get another form to retake the test company said they didn't request the test in the first place and I would have to contact the workers comp insurance company and they said they didn't request a drug test by now I have really got to go so I'm doing the peepee dance and I just want to give my sample I offer to pay myself and they say I can't that it is inadmissible so I payed for one and took it any way now I don't know what to do workers comp said company wanted one and company said it's workers comp that ordered it and I know that in a CMV accident most of the time that you have to submit to a UA with in a certain time can't get a straight answer what do I need to do.Never had a accident in 30 yrs of driving.

    Sometimes you have to walk away from doing what you enjoy, go to school and learn a new way. They only want steering wheel holders now.

    Thanks for the reply but I won't walk away from this I have been driving almost my whole life and I am 56 now I don't know anything else . I think I need to talk to a lawyer to see what my options are any one know one that handles this kinda stuff don't want to see the company just want to keep my cmvl and get on with my life

    I am in my mid 60,s and have had to do that, have kept the cdl and med card up to date, sometimes change is good. except now when I hit the road I can stop where I want, go where I want and learning new stuff aint that bad.

    I'd be more concerned with having an accident, and not remembering details of what happened. Did you maybe black out?

    As you were admitted to a hospital post accident, they did blood tests in the ER. You can get the results from the hospital. Any truck crash that involves injury or death, FMCSA requires a drug test of the driver.
    How long after you were discharged from the hospital did you go to WC doctor? Who sent you to WC doctor? Depending on the amount of time between the two, a drug test at a later date would not be admissible as proof you had either in your system at the time of the incident.

    Can the medical people tell you why you can not remember all that happened? Hopefully you find the problem and get it fixed before even thinking of driving anything. That was a warning you lived thru, next time you and others might not be so lucky.

    1- stop posting

    2 - get a lawyer

    3 - always get names and times with the instructions that you are given

    4 - to others do not ever EVER LEAVE THE OFFICE OR AREA WITHOUT PERMISSION WHEN YOU ARE TO GET ANY DRUG TEST. IT IS A REFUSAL. Don't care if your wife is popping out kids or if your dog died, there is no excuse for it.

    Oh and op, make sure you don't have post concussion symptoms <<<<<< think about that and not remembering what happened.

    Loss of memory is not all that uncommon , short term anyway. The only serious wreck I ever had, I could remember the cause of the wreck, but when I woke up in the ambulance, I couldn't remember if my wife and kids were with me or anything else. The emt told me that my wife was, but she only had a broken leg, so they left her there. That just made it worse as I didn't think they would leave someone there with a broken leg. lol
