No need, I am very familiar with CDL requirements. What he stated is incorrect as stated for two reasons. Reread what he stated and compare with 383.91 (a) (2) and you will see why. In his previous post he was equally incorrect as you pointed out.

in fact you even mentioned one of them.

That's was your post and the one you replied to.
He asked if a class B is needed for a CMV of 26,001 lbs. That is the very definition of needing a class B. He was not wrong.
    A class B is any CMV over 26,000 (so 26,001 and more)/
A class A is any CMV that has a trailer over 10,000 lbs and a total combined weight over 26,000 lbs. Again, except California which requires a class A for any trailer over 10k lbs, regardless of combined weight.

Ok so you said he was correct and then offered him the correction “All are weight ratings by the way“.

What he stated was incorrect. Maybe I’m being too literal.

Maybe you are. But it's weight ratings or actual weight, whichever is greater.

Any vehicle that has an actual weight of 26,001 would need a class B, even if the weight rating is less.

Oh, and the second error was he doesn’t state whether it’s up to 26,001 pounds, over 26,001 pounds, 26,001 and more etc. Go back and look at his previous posts and one would think he believes it was up to, and there was no reason to believe he thought otherwise in the post we are discussing.

Not for the license class at issuance, that’s based on rating. For actually driving you are correct that they will look at Both the GVW or GVWR to determine that you should have had the B.

Look at it this way.....a 3 axle dump truck [in NJ can get a license plate for 75,000 LBS [JOBSITE AREA ONLY] and be driven by a class B...no weight cap except for the GVWR of the trailer [if any].....

Dump service registration, which I’m sure is not cheap. That’s what exempts dump trucks from the Bridge Formula.

No such animal in Virginia though. That’s why dump trucks down there are commonly found with 4 lift axles.

furgettaboutit! Of course NJ is in it for the money....those trucks are legal within a fixed distance around the job-site but need to be MT when relocating back to the yard -or- another job-site

Since these are local only, this was probably a compromise back when the individual counties had their own 'Commercial Vehicle Enforcement' teams running around with portables and a 'tude...

The state stopped them by allocating all MCSAP funding only to the State Police...but once you start giving NJ money, the never give it back!
