    Was he in the hotshot truck, POV, On-Duty or Off? I don't know....just asking. See if he were in a POV, that's the State's fault. He shouldn't have any driving privileges...in the interest of public safety. If he caused that accident with no driving privileges, that would be a completely different conversation.

    I believe his OUIs were all in his personal, he did roll the semi earlier this month...

    He was driving a hot shot, I believe, when the accident occurred.

    I’m not sure on the logbook deal — id imagine he was running a AOBRD.

    Would it matter if he was loaded or not? PC or On Duty Driving?

    Careful, the Mississippi BBQ Master is foaming at the mouth now, descending the X1 grade of 25%, snipers guarding his back...

    The Amicalola Falls looking back up. It's 425 stairs down to the bottom and 425 back up. Luckily I had a two year old "slowing me down" on the way back up. Gotta be in decent shape for this one.

    The company does have responsibility, and will certainly be sued out of existence and the owners bankrupted. If they had anything to begin with.

    As a company owner, I have to do the due diligence on a driver hire to follow the regs. At a minimum an MVR, whiz quiz, and a driving test. I do all that because I'm law-abiding and also responsible about who is piloting my equipment.

    The unfortunate reality is all that gets skirted by less than honorable carriers quite easily. They just put the driver on a 1099 and don't report him to their insurance company. Easy peasy. There's several layers of fail in just that one thing.

    When was the last time you caught an inspection and the police actually verified that you were a covered driver on the carrier's policy? I'll answer that for you: never. They pull up the DOT number to see if there is a policy in effect and that's the end of that. Driver passes.

    The only way the rest might get caught would be a safety audit. Unless the auditor has an eagle eye for false documentation (especially with the D&A file), the carrier can likely get by with fake paper. So another pass.

    The truck he flipped over in Texas? Who is going to warn the carrier about that? There were no charges. The only way that would get caught would be an insurance company checking out the driver prospect. But wait! What if he was never sent to the insurance company? Pass again.

    So what about the CT OUI charge affecting his status in MA? Yeah they screwed up. So what if they didn't? It's not like the cops are going to go on a manhunt to confiscate his license. Nor are they going to waste a 50¢ stamp to mail a letter to the carrier he works for, because they have no idea where he works. Even if they did this carrier seems like one that probably wouldn't read his mail. The only way this matters is if everything else is by the book, which it obviously was not. Pass again.

    Immigration is another layer of crap. To be fair, getting a green card is a process and not easy. I know this having been a sponsor for some Canadian family members. On the other hand, he was a kid at the time so maybe not so much. Regardless, it's another sign of how f-d up our laws are on the topic. IMO he should have had his green card revoked on the 6/26/13 OUI charge before he ever acquired a CDL and considered driving as a career. One of the conditions of legal immigration is being law-abiding. He wasn't. Unfortunately, his immigration status was unaffected. Maybe MA is a sanctuary state and deliberately did not notify ICE. Maybe they did notify and everyone was too busy and forgot to do something. Or maybe the authorities involved felt sorry for him and gave him a 2nd chance. Another missed opportunity and he passes again.

    So what now? IMO he should go through the court system. If found guilty, he needs to serve any prison sentence and then be deported immediately after that's done. Considering who his victims were, I would be amazed if he survived in prison long enough to even make it to deportation.
