You can tell the inspector anything you want. He will do his inspection as usual and write you a ticket for not having an eld when required. It will carry no points and not be an oos violation until April 2018. Shipping is a very weak defense. It's not like this hasn't been coming for 2 years.
Which ELD did you go with

If you are required to keep a RODS for 8 days or more per 30 you must use an eld.

The driver can't, the back office can. An independent is both the driver and the back office so you do the math....

How about a pet hamster?

I thought about it more. Every correction is logged....so they will ask why are you correcting so often.
For me I am also pondering a way to unplug it when I reach Canada as it is not mandated here....yet. -
okay just spoke to DOT , Since I am in California, I can do 22 days of loads in CA and 8 days in any state and I wont need an ELD. Is this what you mean as well?
-
The problem with unplugging it is when you returned to the states it needs to be showing what you did the last 8 days.deathB4decaf Thanks this.

No. It has NOTHING to do with state lines. It has to do with if you are currently required to keep a log book for more than 8 days in a 30 day period.Last edited: Dec 11, 2017

Which would be a legally legitimate excuse for editing in what I scribbled on paper for my days spent in Canada. Raise eyebrows for sure. I run into the situation where I run out of time at a particular customer that wants trucks to show up at night to avoid city rush hour and they begin at 5am. No parking once empty. Bobtail only for pc in Canada. I think fighting rush hour and probably arriving late is a stupid idea when I can just sleep there and scoot across the yard to the door; which is yard move line 4 ruining 8 or 10 hour break. Dumb.

According to DOT, If you are running interstate less than 8 days in a 30 day period, and the rest you are running Intrastate, then you do not need one. I don't know why the man would tell me this on the phone.
