This is a good point and I think the way they constructed the sampling process to account for that is this: At the beginning of each quarter every driver in the pool is included in the list to be sampled regardless of prior tests so if you got chosen in the first quarter and tested well at the beginning of the second quarter you would be included in the list to be sampled again.

With that being said it would be interesting to know if, since they pull the samples quarterly, they only pull 12.5% per quarter to end up at the 50% annually minimum... I should proley stop while I think I know something, haha

The example above of 100 drivers, that 50 have to be tested. But that's not exactly accurate. 100 drivers, there have to be 50 tests given. But at random. Which means that some drivers could have their numbers drawn more than once, while others might go years and not get picked.

Very true. "Random" isn't always random. ;)

Isn't it two instances of random? Day 1 of the quarter the list of total drivers is populated and the required number are selected at random. Following that, throughout the quarter the motor carriers are informed on random dates of the drivers selected from day one.

It appears that the 50% is the minimum per year. Consortiums need to shoot for more, like 55-60% because the pool of driver is fluid and the number of draws depends on the individual Consortiums that appear to have their own rules as to when and what percentage of drivers are selected per each draw - as long as cumulatively they will be at least half.

    So for instance, 1st draw - 25% 2nd z 20- 3rd - 15%. The third draw will ensure meeting the FMCSA requirement of 50% - in this example 60%.
