Who is Responsible?

    OK that's right.
    No one, the editing of it on the back end doesn't have to happen, you have paper that gets processed by the carrier, not the driver, and if they require it to be put into the ELD system, then they do it.
    TO be legal, he would have to reconstruct the past 7 days, even if it isn't accessible from the ELD, and continue logging on paper accurately.
    If the ELD is restored, then the driver can continue to use paper until the next day or create an entry to indicate further logging is on the ELD. and as I said above, the carrier processes it as they see fit.

    Here we wait until the next day to start fresh and use the paper logs until the 7 days are up, then they are filed as supplementally logs and noted in the ELD system.

    Ok, here goes what actually happens from time to time. Company truck with ELD breaks down, company rents one from a rental company. The rental truck has no ELD in it. Driver keeps a paper log from point A to point B where he is put back into a company truck which has a ELD. He sends his paper log into the company, is it the company's responsibility to edit his trip that he used a paper log on or is the responsibility laid on the driver?? Once the driver logs onto the ELD at point B the ELD is only showing him off duty from point A to point B.

    I don't know how to say this differently. It's no one's responsibility to edit the ELD. It's the drivers responsibility to recreate the last 7 days of logs and keep an accurate paper log. It's the companies responsibility to keep those logs for 6 months.
    It's not anyone more complex than that. The paper log never has to be recreated in the ELD.

    Ok did this today so ...
    No problem, drivers have paper log package.
    He is to continue on paper or if instructed by the company, start using the ELD.
    The ELD can show the driver being off duty, he has paper logs which are accepted when there is an issue with the ELD. The driver has to note the movement to the new truck on the paper log and sign it.

    Why are you making this so complicated when it isn't?

    Wait a minute, stop acting like a child, you have a legitimate question which I am glad you asked and it got several answers that are almost all the same.

    What I meant was that sometimes everyone over think things and make it more complicated than it really is. We see this in the new drivers secion and even in the Owners section of this forum.

    One of the biggest problems in this industry is communications, while it sometimes takes several answers to a person to have them understand it. This happens all the time with drivers and agents/brokers.
