who is wrong in this? why?

    Actually, after watching the merge over & over, I dont think he sped up. She slowed once she changed lanes. He is not gaining on the car ahead of him already in his lane as fast as he is gaining on her. He maintained his speed. She slowed once she crossed the center line & forced him into the shoulder & caused him to hit her.

    The question in the op wasnt if he endangered her. The question was, who was at fault. The car was at fault. IMHO, she put everyone's life in danger with her illegal lane change which ultimately caused an accident.

    Yes, but the trucker knew what was going to happen and did a stupid anyway. Both were at fault, even more so the trucker because we should know better.

    I agree. If he hadn't been on the phone & had been paying more attention, he could have possibly prevented an accident. But Legally, SHE is at fault. Legally, he wasn't required to slow down to allow her to merge. SHE is responsible for merging safely. The left lane was HIS lane at that point. She illegally merged & caused an accident.

    I'll just say I'm sure we've all kept someone from passing we felt was being a jerk, I think trucker could've waited but then we aren't there so every instance is different. Its easy to criticize till you yourself is in that situation. Then the gloves come off sometimes.

    Trucker 100%. I avoid a couple of those every day. Most of you do too.
