Who's fault was it?

    If I am this guy's insurance adjuster watching this video, I win the year end party bonus category of 'Most Stupid Client'.

    I call the guy up and say 'good news and bad news', 'bad news is we are dropping you from insurance, but the good news is Swift will take you'

    Let's be real here, this guy was running in the fast lane because he had the phone in his hand slammed up against his grape. He didn't want passing traffic to see him talking on the phone so he merged over to 'hide' his illicit activities. He knew to do this because he probably already has one violation for doing it before and was told if caught again he would lose his license.

    I went back to the video page and read a bunch of comments left by viewers. This guy is trying to justify his behavior still.... but is losing in the court of public opinion. Most are saying get out of the fast lane, it is not 'your' road this and that, if passing, spit or get off the pot already.

    I don't think this guy knows how bad this is for his PSP. I got hit (non preventable) by an SUV plowed into my driver's side fuel tank was we ran side by side on the freeway in December 2010. Because of that I was stuck at Swift for 4 years before I could get a job anywhere else. It's the first thing at the very top of the PSP report -- Crash History. It doesn't account for who is at fault. It is messier than eating speghetti with chopsticks.

    It's funny reading a bunch of internet lawyers throwing a brother under the bus. No doubt the 4wheeler already has a big truck injury lawyer spinning this.

    Not much "spinning" required. The video and audio speaks for itself, and the trucker decided to make it public knowledge :biggrin_25523:
    No court in the world is going to hold the truck driver harmless (not a partial cause of the incident). I get what the trucker was trying to do with posting the dash-cam video but I'm not sure it was in his best interest given certain other aspects of the situation.

    So what the heck was he trying to do? Get cell phones totally banned from trucks, because when truckers are on them they forget how impatient 4 wheelers can be and ends with a couple of dames being rushed to the hospital.

    Some things shouldn't be made public. This isn't Russia and the consequences is very real. It's now easy to find after a hiccup with stupidity.

    Who knows what his intentions were. I was disappointed the car didn't end up like in a Micheal Bay Movie, Big explosions and Auto Bots rescuing a woman in distress.

    To be fair, the truck driver may have felt that without the video he was sure to be accused of "following to close", "failure to maintain", etc. Which is probably correct, after all he did rear-end the vehicle. While the video shows a lot of crap thrown at the trucker that didn't need to be thrown, it also shows a trucker seemingly clueless to his surroundings, and failing to exercise prudent evasive measures in a timely manner ... and chatting on the phone, no less.
