When California and their all knowing CARB guru's say my truck isn't welcome there after 2014, you all can have that State. I reserve the right to run where I want and when I want, period.

Well first and foremost to all you "It's a violation of our rights". Well your flat wrong. See you have no right to be on these roads. It gets no simpler than that. You can be extended the privilege of participation but you have no right to it, and certainly no right to operate your business on it. If compliance with the regulations and laws is so onerous for you people feel free to seek other employment.
Neither of the posted topics to this thread right one new law or regulation. Nope not one. What they do accomplish is enforcing compliance and track failures. Nothing more and nothing less.

Now your special needs argument started you had to much work to do besides drive eg: tarping,securing, handling your load. Well everyone is different however I have found no exemption to the 14 hour rule for you having to work more, nor should there be one. It was my suggestion perhaps you seek pay for those activities to which you responded that you tarped plenty fast to carry out your day.
Glad to see tarping and securing no longer takes up so much time(or possibly your failed argument was exposed) however now your specialness seems to prevent you from driving a full shift without the benefit of a nap.Well still having a hard time finding a regulation stopping you from doing so. So my considered advice is to go ahead and take your nap. No one will care overly much. However your customers may well find some one capable of, as I mentioned, being both safe and compliant.
You know with all your problems perhaps a different career where you can work less would fit someone as special as yourself.

Well if your so adept at avoiding the laws and regulations governing this industry why worry yourself.
See I'm betting it's gonna effect what you claim to be. With the chameleon laws, CSA, GPS corroboration for HOS and IFTA coming on line and insurance companies making people toe the line I expect people that request use of these roads and then scoff at the laws governing it will not find it as funny when they can not buy a policy to book the load to pay their substantial fines.

Scania I can not state how bad our sentences will need to get to put a stop to people killing people in pursuit of customers, or money. I have no problem with someone being convicted of vehicular Manslaughter if they are out of compliance and kill or severely injure someone. In fact I have long been a proponent of far more severe penalties in this country for a myriad of infractions. However those are probably for another discussion. the simple fact is these are going to be used to enforce existing regulations. Could those regulations be changed or modified to accommodate certain circumstances? Possibly, however as it stand they are the letter of the law so to speak(Yes yes Intansit they are a combination of laws and regulations)and should be followed by those requesting permission to operate out here. I will say however we have this round of HOS seen a definition of egregious infractions as opposed to petty infractions. I see that as the FMCSA trying to delineate between the guy running 5 minutes over once a month trying to find parking and the guy just running out of compliance because "He feels like it".otherhalftw and Autocar Thank this. -

sorry, but i'll never give up my career. i make more money now. and i'm doing it on the very FREEDOM THIS COUNTRY WAS FOUNDED ON before your brainwashed govt came along with all there stupid rules. and i'm doing it safely. MY WAY. and i don't drink coffee or take energy drinks to do it just becuase i need to work 14 hours.
there isn't a person in the world that doesn't require some sorta power nap during there work day. OR off day for that matter. don't matter what profession.
hardly anyone sleeps a full 8 hours like you wish they would. let alone 10 hours. the body was designed to recharge itself. and only the body knows when it's time. NOT YOUR NOR THE GOVT CAN CHANGE THAT.

No tazz I'm agreeing with you, what I'm saying is these boxes are not the way to do it cos they simply don't work!! Since their introduction the rate of 'falling asleep' accidents has increased not decreased, they have done nothing here but put small operators and o/o's off the road! I work with these everyday and I promise you they are a nightmare to live with! When they are introduced there as a mandatory thing there will have to be more flexibility but with over zealous cops flexibility is something that won't happen!InTranzit Thanks this. -
EOBR's....for an O/O like myself...and the guys...(all O/O's) I keep in touch with on a weekly basis...we don't need them....
here's why:
1) we really don't run an illegal log...we don't have to nor do we want to!!!....
we don't have a dispatcher or anyone else on us badgering us to drop the load....
if we are late..oh well...
just wait for the next open appt( which is very often 30 min later anyway...big deal) ...
oh..did I mention we drive for the legal hours..or less ( a lot of the time)...
we don't have someone pressuring us to drive beyond the 11 hours ....
we even have several customers of ours state to us:
" don't worry if your late, as long as you get there safe"..
2)If involved in an accident with a 4 wheeler or another vehicle running an Illegal log,
a team of Lawyers is more scary than any DOT officer handing out fines....
that's why we don't run an illegal log now..or probably never will....
3) It's an expense that will someday be required,(to install an EOBR) but for guys like us,
it will never be monitored by a manger, dispatcher, etc....
an expensive useless electronic monitor viewed by a weigh station DOT officer somewhere...someday...
4) Bottom line:...big trucking started using EOBR's due to their grossly mismanaged operation and mis-informed dispatchers..
This way while using EOBR's it takes the responsibility off of the Carrier ( READ BIG TRUCKING) ( for their mis management and complete disregard for safety).
....since big Trucking can't and will not get organized ...
they persuaded their politician buddies to try to push this EOBR thing through to "level their playing field"...
not my playing field...
Myself and the guys ( all O/O's ) I keep in contact with weekly do not even fit into Big Trucking's realm of trucking
( with which they have been using these EOBR's ..and continue using them).

No, let me break the first rule of the interwebs by telling you my lifes story.
Learned from my father how to do heavy haul, OS/OW etc while in high school.
Started my own company with one used POS COE in 1997
went broke, started over
grew to 8 trucks, RGN's, steps, etc...
sold out in 2010. That money has been reinvested and is now my primary income.
working part time now to keep from being bored to death.
Tell me how a prospective buyer goes to his bank to borrow money to buy YOUR company that has no paper trail. Your company is only worth what you can sell your trucks for, your customer base cant be sold as you obviously have no contracts, you cant sue anyone for breaking a contract with you so if you do have contracts they are worthless. How do you sell worthless contracts?
I guess if you plan on driving a truck till you're 85 years old then you've got a great plan. My plan is to build a few successful companies, sell them at a profit, retire on a beach at 55 years old. "Outlaws" cant do that.Autocar and otherhalftw Thank this.
