I don't think that anyone could tell whether a cell phone was being used hands free or not unless they actually witnessed it. The only thing phone records would tell them is whether someone was on their phone.
Why CSA 2010 and E-Logs are a good thing.

I see incoming/outgoing symbols on my call log. And I guess it's been a while since I've used the bluetooth. I'm going to test that later today and see if I can figure out how to show it's a bluetooth call.

Cell phones are being used more and more by LEO to investigate all types of crimes. Most phones today will draw a map of where it has been, giving LEO the ability to track the offender wherever. Then all that needs to be done is place that person in possession of the phone at the time. The features of most of today's phones will tell exactly what that phone is doing as well as a complete history.

Is that true for "dumb phones" too?
I know they can kind of track from the cell site "pings" and stuff. But what other info are they getting from dumb phones? -
Possession is 9/10 of the law . How do you prove who had the phone ? It could have been left in someone else's vehicle . If a driver in an accident had a passenger the passenger could have been using the phone .

Older phones without GPS technology are tracked from the cell provider through the towers, the phone as it moves from one tower to the next sends a signal to the closes tower. Information on the phone is gathered from the provider. Providers track everything you do on your phone to help them provide you with service.

Most of the time the person will just tell you, just like you, people want to tell there story all you have to do is listen. Look around the next time your on a street corner and see how many cameras might have the ability to record you at that time. Bank machines, drive through windows, stores, traffic cameras. You more than likely have your picture taken 100 times a day without you even knowing it.

The only "smart phones" that have EVER been involved in an accident. Have never been reported.
"Smart phones" will crawl away from the scene before LEO arrives.
"Dumb people", will still be holding them in their hands or on their person.
Think about it. Who's name is on the bill? Is it yours or another family member?
If so, your busted.
