Why Do You Exceed The Speed Limit?

    As a commercial driver, we are supposed to be professionals and hold ourselves to a higher standard.

    I see many drivers that treat their truck no different than their personal vehicle. Lane diving, speeding or just being ignorant and cutting people off or holding them back while in the left lane in a govrnd truck.

    When loaded I'm typically running for the best possible fuel mileage. If I hammer down while loaded I'd never get out of the 4's. How ever when empty,.. I'm usually running the speed limit or what ever the traffic, weather and road conditions will safely allow.

    I'm not governed, I just go what I'm comfortable with on back roads. On the interstate where there is always a ton of dot I keep it at 5 over. Haven't gone faster than 85. It's usually 70 around here. I'm not trying to get in trouble even though I'm not governed.

    I work for a small fuel company with old trucks, they don't care about mileage, just don't tear up the trucks and get tickets.

    That lawyer strategy can work both ways. Have a look at the ECM data on the deceased car.

    I wrecked my truck once, went off into the rocks, wrote off the whole works, spent three days in the hospital for a concussion and tri-pod fracture of my left cheek bone.
    I got interviewed by the company insurance rep, at one point he asked what speed I was going. I said 95 kph. He asked what the speed limit was, I says, 90 kph.
    Later I told our safety manager about my slip of the tongue. She said not a problem, when they look at the ecm details and saw that I really was going 95 kph, then it gave them more confidence in my testimony.

    We run dual pay. And always leave the yard within 200 lbs. of gross.

    Within 75 miles it's hourly and run the speed limit, road runs I'm governed at 65 but on 2 lanes I'm 2 or 3 over to try to average the speed limit.

    Crap, I really hope I don't have an incident today. I hit the snooze twice this morning. They are going to argue that I wouldn't have been there if I had just gotten up when my alarm was set. This shows a blatant disregard for responsibility....i knew I should have washed my hands?

    So the lawyer shows he was driving in a normal, accepted manner. Big deal.

    I guess you never know with a jury but very few drive the exact speed limit and the situation you describe has occurred many a time. Has anyone heard of driving in a normal manner like that being used against someone in court?

    If, God forbid, you're ever in such a situation though, don't be surprised if a lawyer scours social media for things that may shine a bad light on your driving habits.
