How was the guard to know he was trying to leave, vs. going to get a weapon? Or, if you want to believe the guard's testimony, he was blocking the driver from going into the guard shack. Without the driver stating what he was doing and then trying to bull his way past we don't know what the driver was attempting.
Well since you are putting words in my mouth I'll go ahead and reply...
While generally I do agree detaining them is wrong, consider this....
Would you be ok if a driver run over the gate at your yard because he didn't want to wait for it to open? What about if he pushed a fork truck out of the way that was on property working, just very temporarily in the way? What about if he mowed down the employees walking across the crosswalk going into the building at shift change? After all, in all those cases he's being detained for a few seconds.
Of course all those examples are ridiculous, just as the few seconds from when the driver claimed (and I don't think he ever stated he wanted to leave) to when he tried to bull past the guard. And we are talking just a few seconds. We are not even talking a full minute.
Yes, if I thought the guard knew he wanted to leave vs any number of other things I would agree with you. I simply do not believe the guard knew he wanted to leave. -
I am anyway.
And while It was a Panther driver I'm talking about, I'm sure they get all sorts in there....
bryan21384 Thanks this. -
Your scenarios are ridiculous and do not parallel in any way what took place in the original incident.
If security were to believe any or all of your scenarios were immediately viable they would have put in place a zero tolerance policy for anyone pulling up to the gate.
This would force them to enact a protocol to immediately take to the ground anyone who pulled in and then figure out there intentions after they were subdued.
This would be unacceptable and against the law.
I respectfully agree to disagree on this.Last edited: Feb 17, 2019

I even admitted they are ridiculous. Doesn't change the fact it was less than a minute he was detained, even if you agree with the driver. Definitely not enough time to excuse trying to push the guard around.
Why are you so happy to defend a driver that thinks the best way to communicate intentions is to physically push people around?gentleroger and bryan21384 Thank this. -
False narrative @ZVar that driver in no way pushed the guard around.
The guard blocked the drivers path causing light contact and the guard proceeded to take him to the ground.drvrtech77 Thanks this. -
I love you keep saying light contact as if that means anything. That's like saying a little pregnant. He made contact. Full stop. That's all that matters.
So again, why do you believe the driver who has shown he prefers to communicate by bullying his way past the guard, vs the video evidence and court testimony?Blackshack46 Thanks this. -
I remember seeing that on the news. Why couldn't the driver just take his hands out of his pockets? Some things are ridiculous but its also easier to just comply to move things alongBlackshack46 and ZVar Thank this.

I guess you don’t understand the concept of light contact with another person?
The next time your in the bank, grocery store or perhaps maybe at church on Christmas and someone brushes against you as they come by make sure you tackle them to the ground.
Maybe you should also punch them out.
After all contact is contact no matter what the degree right?
Your foolish to make that argument.
Every act has an intent or not and a degree with which it was performed.
That’s drivers intent was to get the hell out of there and the degree was light contact because the guard block his exit path.
If you don’t believe there is intent and degree just look at any of the federal and state penal code.drvrtech77 Thanks this. -
There is a huge difference in an accidental touch and attempting to bully your way past someone.
And you still have not answered my question. Why do you believe the criminal more than the video evidence and sworn testimony?
Is it that you prefer to bully people yourself so you see nothing wrong with his bullying? Or is it some other reason?
