Why were you driving it with a bald tire to begin with? I'm pretty sure this is something a driver with your experience would notice during your pretrip.

It starts and ends with the driver. Driver notices a defect on the pre trip or post trip inspections. If you are doing them as required. You write up the tire. Turn in the post trip inspection report, and if there is any defects they are to be corrected before the truck is re-dispatched. The mechanic or carrier official signs the DVIR notating the violation is corrected. Driver comes in and locates the DVIR has been signed, conducts the pre trip and verifies the defect was corrected.
§396.11 Driver vehicle inspection report(s).
(a) Report required(1) Motor Carriers. Every motor carrier shall require its drivers to report, and every driver shall prepare a report in writing at the completion of each days work on each vehicle operated, except for intermodal equipment tendered by an intermodal equipment provider. The report shall cover at least the following parts and accessories:
Service brakes including trailer brake connections
Parking brake
Steering mechanism
Lighting devices and reflectors
Tires
Horn
Windshield wipers
Rear vision mirrors
Coupling devices
Wheels and rims
Emergency equipment
(b) Report content. The report shall identify the vehicle and list any defect or deficiency discovered by or reported to the driver which would affect the safety of operation of the vehicle or result in its mechanical breakdown. If no defect or deficiency is discovered by or reported to the driver, the report shall so indicate. In all instances, the driver shall sign the report. On two-driver operations, only one driver needs to sign the driver vehicle inspection report, provided both drivers agree as to the defects or deficiencies identified. If a driver operates more than one vehicle during the day, a report shall be prepared for each vehicle operated.
(c) Corrective action. Prior to requiring or permitting a driver to operate a vehicle, every motor carrier or its agent shall repair any defect or deficiency listed on the driver vehicle inspection report which would be likely to affect the safety of operation of the vehicle.
(c)(1) Every motor carrier or its agent shall certify on the original driver vehicle inspection report which lists any defect or deficiency that the defect or deficiency has been repaired or that repair is unnecessary before the vehicle is operated again.
(c) (2) Every motor carrier shall maintain the original driver vehicle inspection report, the certification of repairs, and the certification of the drivers review for three months from the date the written report was prepared.
(d) Exceptions. The rules in this section shall not apply to a private motor carrier of passengers (nonbusiness), a driveaway-towaway operation, or any motor carrier operating only one commercial motor vehicle.walleye Thanks this. -

you guys (DOT) just keep doing your job......it's the ignorant to the law/facts for some drivers, so be it....NAIL'EM....when you have to. you're doing a fine job. -
Aw come on, even the staff on this site says you can't run legal and make it in the business...You have to cheat, lie, fudge logs and run on equipment you know will get you in trouble...

The a/c defroster on my truck runs about an hour then quits. Iwas was in the shop for 2 days. What should I do. Not drive it and get fired. Or quit.

Sure bear, that's all great on paper, but what if the carrier doesn't fix it for whatever reason. Then it all falls on the driver, make a stand and lose work/money/job, drive it any way and take the chance of all the bad stuff happening. The carrier doesn't much care. If anything bad happens they have the insurance,lawyers, and the driver to blame.
Now if the carrier knows that if the defect is found by you, the carrier is going to be hit with a big whopping fine, they will fix it or not even let it get to that point.
I'm not saying the driver has no responsibility, I'm saying if the driver does his job there should be something in place to make sure the carrier does their job, and money (fines) is the only thing that will get a carriers attention.
Drivers don't want to drive junk, and the majority don't want to run themselves to death to make a decent living. It's the carriers and shippers who don't really care because they have the driver as a fall guy.Last edited: Oct 22, 2010

Want to be clear about something, I think the driver and DOT should be allies against the carriers and shippers as I believe they are the root of the problem.

now i cannot tell you MY bathroom issues.....maybe she's a better "run into" than i am, but as nana says, log it as it happens. this is what i do as well, "log it as i do it".........it'll work out.
as far as the equipment issue, if you allow yourself to run on bald tires or other safety issues, then you accept the consequences of your actions. will a driver be fired....?? who knows....we only have the word of what, one driver here that was....?? (or did he quit, i don't remember his first posting).
it goes back ( i think) to the o/p "why not ticket the companies, dispatchers"....?? plain and simple, they are NOT driving the trucks.
it doesn't get any simpler than that.
the "diesel cops/bears/DOT" are ONLY DOING thier job, as the driver SHOULD HAVE been doing his job......
