Why ticket the driver

    Seems like an easy choice, the law...And for the 3rd time, if he fires you for not driving something unsafe, can you put that statement on your DAC?...

    You're right. The driver is responsible for his log book. As a safety person I am constantly getting onto our drivers about their logs. They know the rules and regs and if they don't I tell them,look it up in the FMCSR and show them. Then there is no excuse. When a driver tells me the dispatcher told him he had to run to get that load there, I tell them bull. It is your license and your driving record, not the dispatcher. If the dispatcher has a problem with that, send him to me. I will make it clear to them as well. No one is responsible for the driver log book, except the driver. If you break the law, well, you deserve the ticket. DOT has access to the computer programs and I let our drivers know that. One day a hard nosed "diesel cop" may just decide to look at it and then you will be hit with a ton of violations. :biggrin_25524:

    All I can say you are in a no win situation.
    If the boss tells you to do things that are in violation do the best you can do and once you get back to your yard hand in the keys. Give him some sad story and hope he falls for it.
    Some owners out there are a sneeze away from bankruptcy; they are pushing their equipment and drivers to the limit.

    You're a student! While I am a strong proponent of running completely legal and do so myself as an O/O...I find it interesting that you who has zero real world experience at this line of work is so willing to inflict your somewhat flawed view of reality on those that are really out here doing this!

    You can not enter anything on your own DAC report. You can sometimes get erronious information removed but it isn't easy.

    Like I said before...Get back to us after you've been out here for a year or so and let us know how the sanctamonious attitude has worked out for you'

    Until you are really doing this job and have a full understanding of the pressures that some of these guys are under it would be nice of you didn't talk down to them!



    Once you are out here you can say what you want to...As long as you're doing it right!

    Sorry, but my BS-o-meter just redlined and is sitting on the right peg.

    20 minutes from the border, 15 left on his log. Something wrong with Canadian schools that you don't understand simple math?

    The reason I'm standing solid on calling your BS is the very first thread you started here had to do with one of your drivers getting a ticket for HOS. Seems to be a problem with your company. You knew about it then, too because you had him tracked on his QC.

    You're no different from any other bottom-feeder company, just have different license plates. But, as said earlier, nice try.

    (By the way, this does have to do with being caught between the boss and the law. This case demonstrates the choices drivers are forced to make by fly-by-nights like this...er....person. I'm being as nice as I can, Mods.)

    You make it sound like you HAVE to break the rules without having a choice, you either do things right or you don't, this isn't rocket science, there's always a choice...

    I was a commercial pilot, and flight instructor, for years which had the same type of rules and I NEVER found the need to fudge or desire to do so and we had immense pressure to be on time and get the person or cargo where it needed to be...If I find it to be different here, I'll come back, apologize and eat crow but making it sound like we as people don't have choice doesn't sit right with me...

    Because the last place I worked for ran several of their drivers 18 -20 hours a day. one guy had a heart attack and died along the hi-way.And yes the owners know about it. But they tell you when they hire you we run legal. If you don't do what they say they will fire you and put trash on your D.A.C.:biggrin_25515:

    You are wrong on the count that companies do not receive tickets. Ask anyone that has been audited by the FMCSA. But the victim hood spread by those incapable of standing for themselves would spread the story of persecution despite the lie in it's body.

    However the individual driver is personally given a ticket because he made the choice to commit perjury. The irrational fears you claim motivated him are irrelevant. He made the choice to compromise his word. No one can make you compromise your integrity, no one. No one can force you to violate any law.

    All those that say they were coerced, belittled, forced, ordered, or conned into compromising their character are searching for excuses.


    There is no excuse. You turn the key. Accept the responsibility of that action.

    Commercial pilots are very scrutinized.I am not a commercial pilot. I drive Trucks. I try to obey ALL D.O.T regulations. I have a clean license.The only problem I have is the D.O.T. Fails to back me up when I make a decision to park my equipment due to unsafe equipment or violations.How about this one. A undermined amount of time ago my dispatcher told me to drive a sleeper unit without a drivers side mirror in very heavy traffic . The mirror was missing for a week. But it did have the spot mirror on the front hood. Should I have driven it.

    You hit it right on the head! I refused to commit perjury.Got it!!The law enforcement official's refused to back me up. I quit rather than commit perjury. I left and am suffering the consequences. And there are paid off cops. Like that is something new??
