The DOT/FMCSA does require this information, however, they do not as a matter of normal procedure check or clear a driver. What they do however is somewhat more involved on a case by case basis. When the DOT/FMCSA does an audit they will get into those files. The driver qualification files and HOS records are almost always looked at. What they do is bring in a (hitlist) of drivers based on the roadside inspection data and look at their records. Part 391 is clear how a carrier is to do these investigations and inquiries, and what to do if no data can be found or returned. There is no FMCSA rule that states you can't operate a CMV with gaps in your employment history. This is what makes those underlined comments wrong. What you are running into is a lazy HR dept at that carrier placing the blame for their laziness on the DOT.Truckermania Thanks this.
