No, I made no reference to that with Knight. I do however think I was "blackballed" to a degree concerning other jobs I had applied to over the last 5 years.

You seem to be on a quest to pick apart my comments in reqard to this issue and how it relates to part 391 and to be honest it's growing both a bit tiresome and old. Im attempting to break this information down as simply as I can. The revelent sections of 391 have so much in them the entire sub part can't be posted in a single post. Yes there is no check with the FMCSA before hiring. I also don't remember saying it was required. I simply said the DOT requires the information be (sought) and the results made part of the drivers qualification files once hired.

I retired in Dec of 2012 just before Christmas. I can no longer drive anything because of Epilepsy. I have been asked several times now about working in a school. I really wish I could do this. Im 61. I doubt they will ever find a cure in my lifetime.

No, not really just offering clarification which can be accepted or rejected. When responding to the post It appeared you were stating the DOT offered clearance which of course you know they don’t. If you post and don’t expect comments or clarifications i’ll Abide by that.

That dang school should have covered this before you started. Like I said, you are hirable. Find another carrier who has a HR dept that does not have their heads in a blender.

If using someone to give you a reference for work done, or caregiving, whatever, make sure and have it notarized also if possible.

Just for the purposes of clarity, the statement's I underlined are incorrect.

The DOT/FMCSA does require this information, however, they do not as a matter of normal procedure check or clear a driver. What they do however is somewhat more involved on a case by case basis. When the DOT/FMCSA does an audit they will get into those files. The driver qualification files and HOS records are almost always looked at. What they do is bring in a (hitlist) of drivers based on the roadside inspection data and look at their records. Part 391 is clear how a carrier is to do these investigations and inquiries, and what to do if no data can be found or returned. There is no FMCSA rule that states you can't operate a CMV with gaps in your employment history. This is what makes those underlined comments wrong. What you are running into is a lazy HR dept at that carrier placing the blame for their laziness on the DOT.
