My experience is that the DOT is more concerned with the total gross weight, than axle weights. I got an overweight ticket rolling the scales just south of the Budweiser plant in Ft. Collins, CO back in December 2008. I was over gross. (I was hauling pallets and they stuffed a 53' trailer with hardwood floor to ceiling the entire trailer. I was only licensed to 54,000 lbs. and I weighed 58,500 lbs.) I had to pay a fine and buy a day pass for the excessive weight. My company reimbursed me for the cost, but I was real careful after that when I thought I was close. Another time I was pulling a load of pasta sauce from Albany, NY to Denver and they loaded that thing all screwed up. My drives were sitting at 36,500 lbs., but my total was only 76,650 lbs. My tandems were slide all the way forward and my 5th wheel slider was all the was forward also. Nothing I could do would shift the weight any more than I already had. I was more than 50 miles from the shipper when I scaled, so I was stuck with the load. I made it all the way to the first scale house on I70 in KS before I got nailed. Interestingly, I only got a "Warning" and was sent on my way when I told the DOT guy that I did all I could and it was just going to be stuck that way. He told me to avoid the scales in CO, smiled, and wished me a good day. I think it was because I wasn't over gross. I also think the morons at the shipper must have double stacked the freight in the nose. Oh well. The longer you drive a truck, the more you learn about all that can happen and how to prevent it.
